CAPRi began to operate as a systemwide research program on tenure and collective action in the mid-1990s, and became PIM Flagship 5 on governance of natural resources in 2011. From 2021, a renewed research agenda on tenure is essential for advancing the One CGIAR mission of “science and innovation that advance transformation of food, land and water systems in a climate crisis.”

This has been initiated by the large-scale re-distributive activities in former communist countries and by the growing number of claims by displaced indigenous population groups to restore their rights to land. This book provides a timely and clear overview of the historical and theoretical context of current land reform and tenure issues. Illustrated with global case studies from Europe, Asia, Africa and Latin America, key sections explore land and rights to land, property, land tenure and reform, and land registration. Beginning by discussing the need to demarcate space by creating 'invisible lines' - which give certainty to what extent authority over land can be established - the book then explores legal and theoretical definitions of 'land' and 'property' and looks at the various different policies and forms of land tenure. One of the most recent developments in land reform policy has been to look to traditional forms of access to land and of resource conservation. The book argues that, while such policies on land property rights have great potential, they are best being adopted in a long-term, incremental way. This led to the Land Use Act (LUA) of 1978. As a remedial measure to the perceived inadequacy of the traditional tenure system, the act nationalized the control of all land, empowering state governors and local governments with administration and manage-ment of land.1 The act conferred on state governors the custodian right to provide use rights (i.e., the right of occupancy) for land users in their state, dissolving any possessory (freehold) rights to land which were granted by the customary system.

Book excerpt: Tenure security is believed to be critical in spurring agricultural investment and productivity. Yet what improves or impedes tenure security is still poorly understood. Using household- and plot-level data from Ghana, this study analyzes the main factors associated with farmers’ perceived tenure security. Individually, farmers perceive greater tenure security on plots acquired via purchase or inheritance than on land allocated by traditional authorities. Collectively, however, perceived tenure security lessens in communities with more active land markets and economic vibrancy. Migrant households and women in polygamous households feel less secure about their tenure, while farmers with political connections are more confident about their tenure security.

Book excerpt: Within discussions of land and resource rights, there is growing attention to women’s rights, mostly in terms of household and individual rights to private property. This leaves unanswered questions about whether and how women’s land rights can be secured under collective tenure, upon which billions of people worldwide depend. There is an important gap in conceptual tools, empirical understanding, and policy recommendations on women’s land rights within collective tenure. To address this gap and lay the foundations for a sound body of empirical studies and appropriate policies, we develop a conceptual framework to improve understanding of women’s land rights under collective tenure. We begin by discussing what secure tenure for women on collective lands would entail. We then present the conceptual framework for what factors would affect women’s tenure security, building on a framework for land tenure security that focuses on individual and household tenure. We give attention to particularities of rangelands, forests, and other types of lands as well as commonalities across types of collective lands. A key theme that emerges is that for women to have secure tenure under collective tenure, two dimensions must be in place. First, the collective (group) itself must have tenure security. Second, the women must have secure rights within this collective. The latter requires us to consider the governance structures, how men and women access and control land, and the extent to which women have voice and power within the collective. More consistent analyses of collective tenure systems using the framework presented in this paper can help to identify which action resources are important for groups to secure rights to collective lands, and for women to advocate for their rights within the group.
