It presents new evidence on the limited coverage of existing programs and emphasizes the challenges caused by high informality for achieving universal social protection for old age income, health, unemployment risks and anti-poverty safety nets. It identifies interaction effects between SP programs and the behavioral responses of workers, firms and social protection providers, which can further undermine efforts to expand coverage, summarizing evidence from recent work across the region. The book argues for a re-design of financing to eliminate cross subsidies between members of contributory programs and subsidies that effectively tax income from formal employment. It advocates well-targeted, tax-funded, tapered subsidies to provide incentives to the savings efforts of low-income workers, coupled with an effective safety net for the extreme poor who have no capacity to contribute to financing their own social protection arrangements. It also argues for the consolidation of programs and harmonization of benefits packages across different insurers. Strong GDP growth during the commodity boom period led to important gains in employment and a fall in the unemployment rate as labor demand outpaced an increasing labor supply. We emphasize the role of informality in the dynamics of labor markets in Latin America. A re-examination of Okun’s law shows that informality dampens changes in unemployment accompanying output fluctuations. Moreover, we present some evidence that countries with higher redundancy costs and cumbersome dismissal regulations, exhibit “excess” informality over and above what would be expected based on their income and educational levels. Labor market reforms could thus contribute to reducing informality and increasing the responsiveness of labor markets to output growth. However, looking at selected case studies of reforms using the synthetic control method, we find mixed results in terms of labor market outcomes.

To date, Latin America's labor laws remain both rigidly protective and remarkably diverse. Continuity Despite Change develops a new theoretical framework for understanding labor laws and their change through time, beginning by conceptualizing labor laws as comprehensive systems or "regimes." In this context, Matthew Carnes demonstrates that the reform measures introduced in the 1980s and 1990s have only marginally modified the labor laws from decades earlier. To explain this continuity, he argues that labor law development is constrained by long-term economic conditions and labor market institutions. He points specifically to two key factors—the distribution of worker skill levels and the organizational capacity of workers. Carnes presents cross-national statistical evidence from the eighteen major Latin American economies to show that the theory holds for the decades from the 1980s to the 2000s, a period in which many countries grappled with proposed changes to their labor laws. He then offers theoretically grounded narratives to explain the different labor law configurations and reform paths of Chile, Peru, and Argentina. His findings push for a rethinking of the impact of globalization on labor regulation, as economic and political institutions governing labor have proven to be more resilient than earlier studies have suggested.

Many of the policies aimed at reducing poverty and tackling inequality in the 1960-1980 period were well intentioned, but the region made little or no progress in improving income distribution. With the recent shift toward market orientation and openness to international trade, these countries will need a new approach to labor policy as well as different instruments for addressing income distribution goals. This report gives special attention to four areas of labor policy: 1) change from direct government intervention in wage determination and strict seniority rules to a system that rewards effort, high productivity, and good management within a framework that relies on voluntary negotiation of working conditions between workers and firms; 2) replacement of job security legislation by a more effective mechanism that protects workers when they change jobs; 3) careful design of mandatory contributions to social security and other programs in order to minimize the distortionary effect of labor taxes; and 4) redirecting of government subsidies for training and education to the demand side and targeting to those who cannot afford to pay.

Analysing the impact of the reforms on employment it is argued that expectations were not fulfilled with respect to the operation of the labour markets. The reforms limited the expansion of employment in some sectors, particularly in tradeable goods. They also created a bias in labour demad for better educated workers which exacerbates inequality. It is thus made clear that the region faces major challenges both in increasing the number of jobs and improving job equality.

This book evaluates the impact of such neoliberal reforms on labor movements and workers’ rights in the region through comparative analyses of labor politics in Chile, Mexico, Argentina, Brazil, and Venezuela. Using these five key cases, the authors assess the capacity of workers and working-class organizations to advance their demands and bring about a more just distribution of economic gains in an era in which capital has reasserted its power on a global scale. In particular, their findings challenge the purported benefits of labor market flexibility—the freedom of employers to adjust their workforces as needed—which has been touted as a way to reduce income inequality and unemployment. In-depth case studies show how flexibilization as well as privatization, trade liberalization, and economic deregulation have undermined organized labor in all of these countries, leading to the current internal fragmentation of unions and their inability to promote counterreforms or increase collective bargaining. This assessment concludes that even with substantial variation among countries in how reforms have been implemented, most workers in the region have experienced increasing precarity, informal employment, and weaker labor movements. This book provides vital insights into whether these movements have the potential to regain influence and represent working people’s interests effectively in the future.
