Diverse le metodologie usate e le sfaccettature della riforma, stante l'eterogeneità delle materie trattate. Sono tanti gli spunti che la legge n. 124/2015 vuole offrire, alcuni appena accennati, altri più immediati: ed infatti, accanto a disposizioni precettive, leggiamo espressioni e intenzioni (digital first) che attendonTra gli interventi di maggiore impatto, vi è certamente quello sulla disciplina dell'azione amministrativa. I primi sette articoli della norma contengono infatti modifiche particolarmente incisive della legge sul procedimento amministrativo (legge 241/90), con l'immediata e operante rivisitazione dell'autotutela e l'introduzione del nuovo silenzio assenso tra le PA, e con alcuni istituti affidati invece alla normativa delegata, tra cui spiccano la conferenza di servizi, l'accesso ai documenti amministrativi e la riscrittura della disciplina del termine.o una reale declinazione sostanziale nei prossimi mesi. Si intravede, al fine, un disegno compiuto, da leggersi peraltro in modo coordinato con le altre riforme in itinere, che comunque mira alla profonda revisione della macchina organizzativa pubblica. Questo testo si offre pertanto di fornire una lettura ragionata delle nuove norme, in chiave tuttavia coordinata con il contesto trattato, collegando cioè l'analisi delle nuove disposizioni alla indispensabile disamina degli istituti del procedimento amministrativo su cui va a intervenire, così come risultanti dalla incessante elaborazione giurisprudenziale di questo quarto di secolo trascorso dalla emanazione della legge 241/1990. L'intento degli Autori è dunque quello di analizzare la nuova disciplina dell'azione amministrativa offrendo una chiave di lettura critica di quello che sarà il volto della pubblica amministrazione per effetto delle nuove regole.
