Book excerpt: This book provides an up-to-date interdisciplinary assessment of the accountability of executive power in different European States and at the European Union level. From a legal perspective, it wonders to what extent the forms of responsibility and accountability of executive power have evolved in terms of legal technique or framework. From a historical perspective, it looks at the evolution of responsibility paradigms. From a political science perspective, it examines responsibility and the expectations of European democracies in terms of authority and efficiency. The volume also has a quantitative aspect identifying, gathering and analysing statistical material on responsibility and accountability in current political regimes. The book will be a valuable resource for researchers, academics, and policy-makers in constitutional law and politics, public law, comparative law, comparative politics, legal history and government.

Book excerpt: This book describes the development of the criminal law of evidence in the Netherlands, France and Germany between 1750 and 1870. In this period the development occurred that the so-called system of legal proofs was replaced with the (largely) free evaluation of the evidence. The system of legal proofs, which had functioned since the late middle ages, consisted of a set of strict evidentiary rules which predetermined when a judge could convict someone. In this book an explanation is given of the question why between 1750 and 1870 the strict evidentiary rules were replaced with the free evaluation of the evidence. The thesis of this research is that the reform was induced by a change in the underlying epistemological and political-constitutional discourses which together provided the ideas which inspired a significant reform of the criminal law of evidence.

Available in PDF, EPUB and Kindle. Book excerpt: Not since the printing press has a media object been as celebrated for its role in the advancement of knowledge as the scientific journal. From open communication to peer review, the scientific journal has long been central both to the identity of academic scientists and to the public legitimacy of scientific knowledge. But that was not always the case. At the dawn of the nineteenth century, academies and societies dominated elite study of the natural world. Journals were a relatively marginal feature of this world, and sometimes even an object of outright suspicion. The Scientific Journal tells the story of how that changed. Alex Csiszar takes readers deep into nineteenth-century London and Paris, where savants struggled to reshape scientific life in the light of rapidly changing political mores and the growing importance of the press in public life. The scientific journal did not arise as a natural solution to the problem of communicating scientific discoveries. Rather, as Csiszar shows, its dominance was a hard-won compromise born of political exigencies, shifting epistemic values, intellectual property debates, and the demands of commerce. Many of the tensions and problems that plague scholarly publishing today are rooted in these tangled beginnings. As we seek to make sense of our own moment of intense experimentation in publishing platforms, peer review, and information curation, Csiszar argues powerfully that a better understanding of the journal’s past will be crucial to imagining future forms for the expression and organization of knowledge.

Available in PDF, EPUB and Kindle. Book excerpt: Charles Philipon (1800-1862) was the founder of the satirical illustrated press in France. With the newspapers he owned and directed, La Caricature and Le Charivari, he led an unprecedentedly coherent and vitriolic campaign of disrespect against King Louis-Philippe and his regime. Using a group of young caricaturists (the most talented of whom were Daumier, Grandville, and Travies) and the collaboration of a gifted team of writers (including Balzac) he crafted a new language of opposition. This book is the first full scholarly study of the structure of the illustrated press in the 1830s, its contribution to political debate in France, the dissemination of caricature and its potential as political propaganda, and the links between caricature and other forms of political-cultural discourse under the July Monarchy.

Available in PDF, EPUB and Kindle. Book excerpt: In When the French Tried to Be British, J.A.W. Gunn studies the French effort during 1814 to 1848 to adopt the set of common understandings that lent a comparative stability to British government. The institutions of a loyal opposition and disciplined political parties seemed to be implicit in the parliamentary model, but their acceptance foundered on French reluctance to accord legitimacy to political opponents. A sophisticated minority - including such major figures as Chateaubriand, Constant, Mme de Sta l, and Guizot - recognized the need for something approaching the British political culture, but the wounds opened by the Revolution could not readily be healed. A more or less complete acceptance of the civil disagreement that was the spirit of the British model had to await the Fifth Republic.

Available in PDF, EPUB and Kindle. Book excerpt: This book sheds light on the unique aspects of ‘communal liberalism’ in Mme de Staël’s writings and considers her contribution to nineteenth-century French liberal political thought. Focusing notably on the ‘Considérations sur les principaux événements de la Révolution française’, it examines the originality of Stael’s liberal philosophy. Rather than contrasting liberalism with either multiculturalism or republicanism, the book argues that Staël’s communal liberalism challenges the conventions of nineteenth-century political thought, notably through her assertion of the need to institutionalize an organic intermediary connecting the two spheres, an idea later advanced by thinkers such as Jürgen Habermas. Offering a critical reappraisal of Staël’s multifaceted work, this book assesses the political impact of her work, arguing that the political influence of the ‘Considérations’ permeates the liberal historiography of the French Revolution up to the present day.
