Los daños pueden padecerlos también quienes no son considerados consumidores en sentido legal, pero el principio constitucional de protección del consumidor exige una mayor protección a las víctimas, lo que dio lugar a la promulgación de un régimen específico de responsabilidad. Sin embargo, la presencia de otras finalidades e intereses, como la armonización de las normas de los Estados para garantizar la libre circulación de las mercancías en el mercado interior de la Unión Europea o la posibilidad de lograr seguros de responsabilidad más baratos, ha propiciado la promulgación de normas que suponen un recorte en la protección de los intereses de los consumidores. Junto a ello, el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios regula de manera conjunta la responsabilidad del suministrador de un servicio y la del fabricante de productos defectuosos, pero la relación entre ambos regímenes es extremadamente difícil. Este libro ofrece respuestas a los complejos problemas de interpretación que se plantean en el ámbito de los daños a consumidores (¿quién debe responder?, ¿de qué daños?, ¿con arreglo a qué régimen de responsabilidad?).
