Le livre préliminaire traite de l'originalité de l'accident de trajet qui n'a été reconnu que par la loi de 1946 ayant confie à la sécurité sociale la gestion de risques professionnels. Depuis lors, cette catégorie juridique a essaime dans d'autres législations de droit interne ou étrangères. L'étude de la qualification de l'accident de trajet en droit positif fait l'objet du livre premier. La jurisprudence atteint des sommets de complexité en raison des problèmes de frontières avec l'accident de travail proprement dit et l'accident de droit commun. Cette complexité pourrait être dépassée si l'on admet que l'accident de trajet constitue un risque de l'emploi. Le second livre est consacre à la réparation de l'accident de trajet caractérisée à l'origine par une réparation forfaitaire du préjudice subi par la victime. Cependant, dans le sillage de l'obligation d'assurance des véhicules a moteur, tout comme en présence d'un accident du travail constituant un accident de la circulation au sens de la loi du 5 juillet 1985, les victimes peuvent accéder à la réparation intégrale de leur préjudice par le biais d'un recours complémentaire, sans exclusive, contre l'auteur responsable de l'accident. La question d'avenir est pour l'auteur celle de la réparation intégrale de l'ensemble des victimes des risques professionnels dont l'accident de trajet a été l'aile conquérante. Trois voies sont examinées : 1) progression au coup par coup déjà amorcée sous l'influence de la protection des victimes des accidents de la circulation : voie empirique, interminable et discriminatoire ; 2) adjonction a la législation spéciale des accidents du travail, des contrats d'assurances privées complémentaires ; 3) reforme générale de la législation des accidents du travail axée sur la réparation intégrale, a l'instar de la loi de 1985 relative aux victimes des accidents de la circulation, ce qui implique le financement par les générateurs de risques.

The social sciences have been accumulating knowledge since the early fifties as to how we are regulated by others. S. Milgram, S. Ashe, P. Zimbardo and J. Calhoun, detail the vulnerability to being duped and deceived and the difficulty of cooperating when values differ. Murray Bowen, M.D., the first researcher to observe several live-in families, for up to three years, at the National Institute of Mental Health. Describing how family members overly influence one another and distribute stress unevenly, Bowen described both how symptoms and family leaders emerge in highly stressed families. Our brain is not organized to automatically perceive that each family has an emotional system, fine-tuned by evolution and "valuing" its survival as a whole, as much as the survival of any individual. It is easier to see this emotional system function in ants or mice but not in humans. The emotional system is organized to snooker us humans: encouraging us to take sides, run away from others, to pressure others, to get sick, to blame others, and to have great difficulty in seeing our part in problems. It is hard to see that we become anxious, stressed out and even that we are difficult to deal with. But "thinking systems" can open the doors of perception, allowing us to experience the world in a different way. This book offers both coaching ideas and stories from leaders as to strategies to break out from social control by de-triangling, using paradoxes, reversals and other types of interruptions of highly linked emotional processes. Time is needed to think clearly about the automatic nature of the two against one triangle. Time and experience is required as we learn strategies to put two people together and get self outside the control of the system. In addition, it takes time to clarify and define one's principles, to know what "I" will or will not do and to be able to take a stand with others with whom we are very involved. The good news is that systems' thinking is possible for anyone. It is always possible for an individual to understand feelings and to integrate them with their more rational brains. In so doing, an individual increases his or her ability to communicate despite misunderstandings or even rejection from important others. The effort involved in creating your Mindful Compass enables us to perceive the relationship system without experiencing it's threats. The four points on the Mindful Compass are: 1) Action for Self, 2) Resistance to Forward Progress, 3) Knowledge of Social Systems and the 4) The Ability to Stand Alone. Each gives us a view of the process one enters when making an effort to define a self and build an emotional backbone. It is not easy to find our way through the social jungle. The ability to know emotional systems well enough to take a position for self and to become more differentiated is part of the natural way humans cope with pressure. Now people can use available knowledge to build an emotional backbone, by thoughtfully altering their part in the relationship system. No one knows how far one can go by making an effort to be more of a self-defined individual in relationships to others. Through increasing emotional maturity, we can find greater individual freedom at the same time that we increase our ability to cooperate and to be close to others.

Book excerpt: Belgium has a unique place in the history of migration in that it was the first among industrialized nations in Continental Europe to develop into an immigrant society. In the nineteenth century Italians, Jews, Poles, Czechs, and North Africans settled in Belgium to work in industry and commerce. They were followed by Russians in the 1920s and Germans in the 1930s who were seeking a safe haven from persecution by totalitarian regimes. In the nineteenth century immigrants were to a larger extent integrated into Belgian society: they were denied political rights but participated on equal terms with Belgians in social life. This changed radically in the twentieth century; by 1940 the rights of aliens were severely curtailed, while those of Belgian citizens, in particular in the social domain, were extended. While the state evolved into a "welfare state" for its citizens it became more of a police state for immigrants. The state only tolerated immigrants who were prepared to carry out those jobs that were shunned by the Belgians. Under the pressure of public opinion, an exception was made in the cases of thousands of Jewish refugees that had fled from Nazi Germany. However, other immigrants were subjected to harsh regulations and in fact became the outcasts of twentieth-century Belgian liberal society. This remarkable study examines in depth and over a long time span how (anti-) alien policies were transformed, resulting in an illiberal exclusion of foreigners at the same time as democratization and the welfare state expanded. In this respect Belgium is certainly not unique but offers an interesting case study of developments that are characteristic for Europe as a whole.
