Book excerpt: The complex legal situations arising from the coexistence of international law, state law, and social and religious norms in different parts of the world often include scenarios of conflict between them. These conflicting norms issued from different categories of ‘laws’ result in difficulties in describing, identifying and analysing human rights in plural environments. This volume studies how normative conflicts unfold when trapped in the aspirations of human rights and their local realizations. It reflects on how such tensions can be eased, while observing how and why they occur. The authors examine how obedience or resistance to the official law is generated through the interaction of a multiplicity of conflicting norms, interpretations and practices. Emphasis is placed on the actors involved in raising or decreasing the tension surrounding the conflict and the implications that the conflict carries, whether resolved or not, in conditions of asymmetric power movements. It is argued that legal responsiveness to state law depends on how people with different identities deal with it, narrate it and build expectations from it, bearing in mind that normative pluralism may also operate as an instrument towards the exclusion of certain communities from the public sphere. The chapters look particularly to expose the dialogue between parallel normative spheres in order for law to become more effective, while investigating the types of socio-legal variables that affect the functioning of law, leading to conflicts between rights, values and entire cultural frames.

Diversity and Aging among Immigrant Seniors in Canada breaks from that tradition and offers an eclectic collection of original research from among Canada's leading researchers on aging and immigrants. Some researchers refer to this emerging field as Ethno-gerontology. There are two interesting groups of immigrant seniors: those who entered Canada at over 65 years of age, and those who aged in Canada. Most Canadians are surprised to learn that the senior population of seniors has a higher percentage of immigrants (19.6%) than the general population (13.7%). As Canadians age, the country's composition of immigrant seniors has also changed from mainly European to greater cultural and ethnic diversity from Africa and Asia. This cultural and ethnic diversity has social/health/economic policy implications and impacts on programs and services delivered to seniors. Diversity and Aging among Immigrant Seniors in Canada is divided into two main sections. In Part 1, the chapters explore general and universal issues such as national trends and demographics, theoretical orientations, issues of culture and legal dimensions, poverty and income, and end-of-life care. What we see is the trivialization of research protocols which, consequently, are reduced to fantasy prescriptions that detach social studies from universal debates over the validity of science rather than an interrogation of research procedures induced by the complexity of social dynamics. As a result, social sciences have become an imitative discourse and a recital of exotic anecdotes without perspectives. Knowledge production therefore loses any heuristic bearing. It is on the basis of this reality that attempts to correct this tendency have been made in this book by discussing the methodological foundation of social science knowledge. This volume is a collection of papers presented during methodological workshops organized by CODESRIA. Its objective is to revitalize theory and methodology in field work in Africa while contributing to the creation of a critical space hinged upon the mastery of epistemological bases which are indispensable to any scientific imagination. Far from being a collection of technical certainties and certified methods, this book interrogates the uncertain itinerary of the process of social logics discovery. In that sense, it is a decisive step towards a critical systemization of ongoing theories and practices within the African scientific community. The reader can, therefore, identify the philosophical, historical, sociological and anthropological foundations of object construction, field data exploitation and research results delivery. This book explains the importance of the philosophical and social modalities of scientific practice, the influence of local historical contexts, the different usages of new investigative tools, including the audiovisual tools. Finally, the book, backed by classical theories, serves as an invitation toward considering scientific commitment to African field research from a reflective perspective.
