Book excerpt: Since its launch in 1995, the majority of personal data held in the Schengen Information System (SIS) concerns third-country nationals to be refused entry to the Schengen territory. This study reveals why the use of the SIS (and the second generation SIS or SIS II) entails a risk to the protection of human rights such as the right to privacy and the right to data protection, but also the freedom of movement of persons and the principle of non-discrimination. This study describes the implementation of the SIS in respectively France, Germany, and the Netherlands and the available legal remedies in both data protection and immigration law. On the basis of three general principles of European law, minimum standards are developed for effective remedies for individuals registered in the SIS, but also other databases such as Eurodac or the Visa Information System.

The author classifies the basic human rights of aliens into seven different categories, namely: 1) fundamental rights; 2) private rights; 3) social and cultural rights; 4) economic rights; 5) political rights; 6) public rights; and 7) procedural rights. For each of these categories she reviews opinions of international legal commentators, decisions of international and regional tribunals, as well as national legislation, domestic court decisions, and opinions of local authorities.

Balibar moves deftly from state theory, national sovereignty, and debates on multiculturalism and European racism, toward imagining a more democratic and less state-centered European citizenship. Although European unification has progressively divorced the concepts of citizenship and nationhood, this process has met with formidable obstacles. Book excerpt: This dissertation argues that there has been a shift in emphasis in contemporary France from a regime of systematicity and justice, grounded in the rule of law, to a narrower ethics of exceptionality and benevolence, based on a politics of humanitarianism and compassion. I examine this shift from the angle of those most impacted by the failure of the rule of law - immigrants, particularly undocumented immigrants - or those called "les sans papiers" in France. Based on ethnographic field research in Paris from 1999-2001 with undocumented immigrants, activist groups, lawyers, immigration officials, nurses, doctors and social workers, this dissertation documents how, as one example of this shift, illness has become a primary means by which to stay in France legally. It demonstrates how this emergent ethics has turned the politics of immigration into a politics of life and death, where one must barter one's suffering for inclusion in the concept of humanity.

Based on a unique socio-demographic survey carried out both in origin and destination countries (MAFE survey), it argues that return migration, circulation, and transnational practices are significant. Policy design must also take these factors into account. Comparing in a systematic way three flows of African migrants (from Democratic Republic of Congo, Ghana and Senegal), this study offers a new view on the patterns, determinants, and family and economic effects of migration. By comparing six European countries (Belgium, France, Italy, the Netherlands, Spain and the UK), it shows that the dynamics of migration differ greatly in new vs. old destination countries. Based on a statistical analysis of life histories, this study provides a dynamic view of migration that will help readers better understand current trends as well as future trajectories. It will appeal to researchers, academics, practitioners, and others interested in taking a deeper look in (im)migration issues.
