Book excerpt: Questa ottava edizione del manuale di Giustizia costituzionale continua a ispirarsi all’idea originaria di un volume che si propone finalità essenzialmente di tipo didattico, scritto, per quanto ci siamo riusciti, in maniera chiara, lineare e privo di note, con gli accorgimenti che hanno via via consentito, nei nostri auspici, di rendere più agevole la lettura del testo, vale a dire i titoletti, la nota bibliografica, l’indice analitico. Il volumetto contenente gli atti normativi permette di reperire con immediatezza le fonti sulla giustizia costituzionale. La necessità di ricorrere a una nuova edizione sta essenzialmente nella rapida evoluzione della materia e, in particolare per questa edizione, nella applicazione delle modifiche introdotte dalle nuove Norme integrative, presentate dalla stessa Corte come una apertura all’“ascolto della società civile”; così come nel dar conto di alcuni importanti interventi giurisprudenziali di questi ultimi anni, qualificanti anche per il ruolo assunto dal Giudice costituzionale nel nostro sistema istituzionale. Con riguardo alla disciplina dell’attività della Corte, si segnalano il decreto del Presidente che ha emanato le regole tecniche per l’attuazione del processo costituzionale telematico (2021), così come le più recenti modifiche al Regolamento generale (delibera 17 giugno 2024), che hanno interessato le articolazioni interne dell’organo. Si dà, infine, conto di alcune tensioni, sul finire del 2023, prodotte dalla regola di segretezza delle deliberazioni dell’organo, in collegamento con dichiarazioni rese dai giudici. In generale, la più recente giurisprudenza pare confermare il progressivo spostamento, già segnalato nella edizione precedente, della Corte costituzionale verso l’anima “politica”, attraverso il ricorso a tecniche decisorie tendenti ad acquisire spazi più ampi in rapporto al tradizionale problema del rispetto delle scelte discrezionali del legislatore. Tali tecniche decisorie sembrano avere in comune il fatto di fondarsi sulla logica del bilanciamento tra diverse esigenze espressive di differenti principi, ritenuti non realizzabili congiuntamente. Tra queste principalmente le c.d. decisioni a due o più fasi, attraverso le quali la Corte si esprime sul merito (nel senso della incostituzionalità), ma con una ordinanza interlocutoria che sospende il giudizio, assegnando un termine al legislatore per intervenire. Qualora il legislatore non lo faccia, essa procede, con sentenza, alla dichiarazione di incostituzionalità, dettando la necessaria disciplina e realizzando così la massima espansione del potere normativo della Corte.
