Book excerpt: El presente libro analiza las normas de la Unión Europea, del Estado Español y de la Comunidad Valenciana que regulan la gestión urbanística, así como la jurisprudencia del TJCE, del Tribunal de Primera Instancia de la Unión Europea y del TEDH, por un lado, y del TC, del TS y del TSJCV, por otro, que versan sobre tal cuestión, haciendo especial hincapié en su incidencia en las diversas formas, directas e indirectas, de la mencionada gestión (de entes públicos y de particulares, propietarios y no propietarios), así como en la exigencia de aplicación de la normativa contractual pública y la garantía del derecho de propiedad privada. Ello, con la finalidad de proporcionar al ámbito académico y al de los operadores jurídicos una visión lo más completa posible de dicha temática, que pueda ser útil para la interpretación y aplicación de dicho Derecho en su hacer cotidiano. Pero también con el objetivo de suministrar la base para examinar el conflicto suscitado por la Resolución del Parlamento Europeo de 5 de diciembre de 2005 (adoptada sobre la base del Informe Fourtou) y por la apertura por la Comisión Europea a España, mediante la Carta de emplazamiento de 21 de marzo de 2005, de un expediente de infracción del Derecho Comunitario, como consecuencia de que la legislación urbanística valenciana no respeta las normas sobre contratos públicos de la Unión. Y, en relación con el Derecho Valenciano, se expone, en especial, con gran grado de detalle, la regulación de la referida gestión a partir de la exégesis en dicho Derecho de la distinción entre actuaciones integradas y actuaciones aisladas, pasando por la cuestión de la distribución de las cesiones y de los gastos y demás cargas de la urbanización, hasta llegar al estudio de los procedimientos de adjudicación de los PAIS y PAAS y de la condición de agente urbanizador de los mismos, por un lado, así como de la posición de empresario constructor, por otro.

Marta Lora-Tamayo Vallvé es Profesora Titular de derecho administrativo en la UNED. Ha dedicado la mayor parte de su labor investigadora al urbanismo desde una perspectiva histórica y comparada.
