Los autores que sustentan esta posición, más allá de sus diferencias, argumentan que estas democracias adolecen de una crisis de representación que pone en duda su legitimidad: la carencia de medios de participación ciudadana en la toma de decisiones desvirtúa la premisa de la voluntad general. Asimismo, al subordinarse a la lógica económica, no resultan garantía suficiente para el ejercicio de los derechos humanos. Esto las convierte en democracias meramente formales. La resistencia entendida como 'desobediencia civil' invisibiliza los modos de dominación porque está planteada desde la exclusiva óptica de los derechos civiles y políticos, haciendo abstracción de los derechos sociales y económicos. Esto revelaría cierta contradicción en el discurso del liberalismo político dado que las bases materiales no concuerdan con la premisa de igualdad en la que pretende basarse el sistema democrático.
