Determined to root out the “many Cains among us,” as a Poznań newspaper editorial put it, Poland’s judicial reckoning spawned 32,000 trials and spanned more than a decade before being largely forgotten. Andrew Kornbluth reconstructs the story of the August Trials, long dismissed as a Stalinist travesty, and discovers that they were in fact a scrupulous search for the truth. But as the process of retribution began to unearth evidence of enthusiastic local participation in the Holocaust, the hated government, traumatized populace, and fiercely independent judiciary all struggled to salvage a purely heroic vision of the past that could unify a nation recovering from massive upheaval. The trials became the crucible in which the Communist state and an unyielding society forged a foundational myth of modern Poland but left a lasting open wound in Polish-Jewish relations. The August Trials draws striking parallels with incomplete postwar reckonings on both sides of the Iron Curtain, suggesting the extent to which ethnic cleansing and its abortive judicial accounting are part of a common European heritage. From Paris and The Hague to Warsaw and Kyiv, the law was made to serve many different purposes, even as it failed to secure the goal with which it is most closely associated: justice.

Moving on to incorporate the developments of the Roman and the Christian traditions, a contemporary conservative-republican political philosophy is built up. Special attention is given to the relevance of local customs and traditions as well as participation, compromise and moderation in political activity. The book demonstrates that Aristotelian notions should be used to describe the actions and speeches of people active in politics, without losing sight of the normative dimension. In doing so, it presents an original argument which is both different from mainstream contemporary political philosophy and beneficial to our understanding of the role of practical reason in politics.

Book excerpt: History is no longer the exclusive domain of historians, but is now often used as a tool for politics. It is not without reason that the term “state historical policy” has been coined, which must be a kind of aberration for those who believed that the role of history is to objectively determine the course of events. The fact is, however, that the distortion of historical facts, the concealment of crimes is now part of the “information war”. Therefore, new acts of public international law, EU law and national law are introduced in order to combat public condonation, denial or gross trivialisation of the core international crimes which are certain forms and expressions of racism and xenophobia. States have to determine for themselves how they understand “denial” or “gross trivialization”, which may lead to abuse. In many cases, when introducing criminal law provisions, States wish to decree historical truth, to establish once and for all the general facts and determine who was the victim, and who was the perpetrator. This does not have to be the result of bad will, but of a desire to exclude the possibility of nuance, which could turn into dangerous trivialisation. The aim of this publication is to specify the reasons for holding accountable for denial of international crimes, indicate legal obligations in this respect, look at the Polish case, both in terms of criminal provisions (partly repealed) and standards of a civil law nature, and compare the Polish regulation with the legal systems of other states, which were chosen because of the region (Central and Eastern Europe) or due to having current problems with denial of crimes or doubts about prosecution on this account.

Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processes became palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. New Forms of Rule in Medieval and Renaissance Europe uses a comparative approach to examine the phenomena of the medieval and renaissance unions in a pan-European overview. In the later Middle Ages, genealogical coincidences led to caesuras in various dynastic successions. Solutions to these were found, above all, in new constellations which saw one political entity becoming co-managed by the ruler of another in the form of a personal union. In the premodern period, such solutions were characterised by two factors in particular: on the one hand, the entry of two countries into a union did not constitute a military annexation — even though claims to the throne were all too often imposed by force; on the other hand, the new unitarian constellation retained, at least de jure, the independence of its respective components. The twenty-four essays, ranging in scope from Scandinavia to Iberia, from England and France to Central and Eastern Europe, examine whether the respective unions were the result of careful planning and deliberations in the face of a long-foreseen succession crisis or whether they emerged from dynamic developments that were largely reactive and dependent upon various random factors and circumstances. Each union is assessed to provide an understanding, for students and researchers, of the political and social forces involved in the respective countries and investigates how the unions were reflected in contemporary literature (pamphlets, memoranda, chronicles, diaries etc.), propaganda and in legal and historical discourses. This volume is essential reading for students and researchers interested in the history of monarchy, political history and social and cultural histories in premodern Europe.
