Book excerpt: Cet ouvrage, divisé en deux tomes, a pour ambition de livrer au lecteur une étude panoramique mais détaillée des méandres du droit à un procès pénal équitable consacré par l’article 6 de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales. Il analyse, pour chacune de ses garanties, non seulement la jurisprudence des organes du Conseil de l’Europe mais encore leur interprétation par la doctrine et la jurisprudence belges. L’objectif est d’apprécier la réception et l’incidence, dans la pratique des juridictions répressives belges, du droit à un procès équitable tel qu’il est garanti par l’article 6 de la Convention. Ce traité de référence se divise en cinq titres. Le premier volume et son titre I est consacré à l’étude des droits garantis au paragraphe 1er de l’article 6 et des garanties institutionnelles du droit à un procès équitable que sont les exigences d’institution légale du tribunal et d’indépendance et d’impartialité des magistrats. Le titre II s’attache aux garanties d’une bonne administration de la justice qui ne sont pas propres à la procédure pénale, tels que le droit d'accès aux tribunaux, le droit à la comparution personnelle et à la représentation, le principe de l’égalité des armes, le respect des droits de la défense, la contradiction des débats, la motivation ou encore le droit à la publicité des débats et du prononcé du jugement. L’exigence de délai raisonnable constitue le titre III et inaugure le deuxième volume. Le titre IV analyse la présomption d’innocence et le droit au silence. Le cinquième et dernier titre concerne les droits spécifiquement reconnus à la personne poursuivie par le paragraphe 3 de l’article 6 de la Convention ainsi que le droit au double degré de juridiction et le principe non bis in idem. Ce livre constitue un instrument de travail destiné aux magistrats, avocats, enseignants, chercheurs et étudiants.

The structure and operation of French criminal justice is set within a broad range of contexts of political, occupational and legal cultures from the French Republican tradition of state-centred models of authority, across the growing influence of the ECHR, to the local conditions which determine the ways in which individual discretion is exercised. The French model of investigative supervision and accountability is contrasted with more adversarial procedures and in particular, the different ways in which the reliability of evidence is guaranteed and the interests of the accused protected. Systematic observation of the daily working practices of police, gendarmes, prosecutors and juges dinstruction across a number of sites and time periods, provides a unique and detailed account of the ways in which the French criminal process operates in practice.
