Book excerpt: This title was first published in 2000: This work describes the United Nations International Criminal Tribunal for Rwanda (ICTR) - the first international court created to try persons for genocide and violation the humanitarian law of non-international armed conflict. The book begins with an explanation of the causes of the 1994 genocide in Rwanda. It then discusses the UN Security Council's creation of the ICTR and the Tribunal's organization, functioning, accomplishments and shortcomings. The author explains how the Tribunal has gained custody over suspects who had fled to other countries in Africa, Europe and also to the USA. The book analyzes the ICTR's first several cases and describes the unique contributions the Tribunal is making to the expansion of humanitarian law. In addition, the author describes Rwanda's own legal attempts to deal with the trauma of 1994 by passing a new genocide statute and creating special genocide courts. He also explains the similiarities and differences between the Tribunal for Rwanda and the one created by the UN Security Council to deal with major crimes committed during the break-up of former Yugoslavia.

It aims to demonstrate the challenges of the management of knowledge for restorative justice in Africa and the principles and practices by which these challenges can be met. To achieve this aim they applied what they call the 'Trans-dimensional Knowledge Management Model (TDKM-M)' to specific cases of restorative justice in South Africa, Rwanda, Uganda, Kenya and Liberia. After an analysis of the cases studies, the author successfully demonstrated the challenges of the management of knowledge for restorative justice in Africa and the principles and practices by which these challenges can be met. The authors revealed common challenges to restorative justice such as establishing the 'truth'; the institutionalisation of recommendations by truth and reconciliation bodies; the handling of non-cooperative offenders; and replacing of 'good' values' with 'bad' values as major challenges to restorative justice. To meet these challenges, they propose certain principles of trans-dimensional restorative justice: the establishment of a 'trans-dimensional knowledge foundation' (not some version of 'the truth'); leadership in the implementation of strategies and plans; restoration or establishment of good relations among all people (not only the ruling elites); the identification of tacit and unseen factors that will determine successful restoration of these relationships; and changing these tacit and unseen factors.

Book excerpt: Examining how international criminal law has—and hasn’t—brought justice following war crimes in Africa Ever since World War II, the United Nations and other international actors have created laws, treaties, and institutions to punish perpetrators of genocide, war crimes, and crimes against humanity. These efforts have established universally recognized norms and have resulted in several high-profile convictions in egregious cases. But international criminal justice now seems to be a declining force—its energy sapped by long delays in prosecutions, lagging public attention, and a globally rising authoritarianism that disregards legal niceties. This book reviews five examples of international criminal justice as they have been applied across Africa, where brutal civil conflicts in recent decades resulted in varying degrees of global attention and action. The first three chapters examine key international mechanisms: the International Criminal Court, the International Criminal Tribunal for Rwanda, and the hybrid tribunal established in Senegal to try state crimes committed in Chad. These chapters illustrate how the design and practice of the institutions led to similarly unexpected and unsatisfying outcomes. The final two chapters examine emerging and proposed international criminal justice mechanisms. One is a tribunal intended to facilitate peace in the new but war-torn country of South Sudan, not yet operational and unlikely to perform better than its predecessors.
