For this purpose, internationally leading experts write contributions on specific topics of transportation law. The authors compare different legal approaches and present conceptually convincing answers. In addition, they discuss unsolved issues in transportation law. In a first step, the challenges and chances regarding the transformation of the transportation market will be illustrated. Subsequently, several key topics such as the basic principles in transportation law, regulative frameworks form digital freight documents and a look towards a modern logistics will be covered. In conclusion, the insights for a reform in Swiss transportation law reform are identified.

Available in PDF, EPUB and Kindle. Book excerpt: The coming of the railways signalled the transformation of European society, allowing the quick and cheap mass transportation of people and goods on a previously unimaginable scale. By the early decades of the twentieth century, however, the domination of rail transport was threatened by increased motorised road transport which would quickly surpass and eclipse the trains, only itself to be challenged in the twenty-first century by a renewal of interest in railways. Yet, as the studies in this volume make clear, to view the relationship between road and rail as a simple competition between two rival forms of transportation, is a mistake. Rail transport did not vanish in the twentieth century any more than road transport vanished in the nineteenth with the appearance of the railways. Instead a mutual interdependence has always existed, balancing the strengths and weaknesses of each system. It is that interdependence that forms the major theme of this collection. Divided into two main sections, the first part of the book offers a series of chapters examining how railway companies reacted to increasing competition from road transport, and exploring the degree to which railways depended on road transportation at different times and places. Part two focuses on road mobility, interpreting it as the innovative success story of the twentieth century. Taken together, these essays provide a fascinating reappraisal of the complex and shifting nature of European transportation over the last one hundred years.

Available in PDF, EPUB and Kindle. Book excerpt: We live in a chaotic world. Some of the chaos results from poor decision-making (e.g., Enron, Arthur Andersen, WorldCom). Yet other aspects of chaos (war, terrorist attacks, etc.) are beyond a firm's control. This book demonstrates that firm growth is more dependent on how a firm develops its resource base over time. Examining actual firm growth in several industries, with a focus on trucking, the airline industry, and the North American railroad industry, Pettus shows that a specific resource sequencing leads to higher firm growth than other sequencing patterns. This sequencing pattern is similar across transportation industries, and the pattern may be applicable to other industries. Decisions that firms make with respect to how resources are developed must balance the need for growth in the current time period with the need for growth over the long term. Firms can build sustainable growth by developing resources in a specific sequence; in essence, firms have control over their growth, even when confronted with ever-changing environmental conditions.

Available in PDF, EPUB and Kindle. Book excerpt: Analyzing sex-offense laws and false claims, this book shows that laws based on vengeance rather than justice or evidence create new forms of harm while failing to address the real and pervasive problem of sexual violence. In this timely and extensively researched book, sociologist Emily Horowitz shows how current sex-offense policies in the United States create new forms of harm and prevent those who have caused harm from the process of constructive repentance or contributing to society after punishment. Horowitz also illustrates the failure of criminal justice responses to social problems. Sharing detailed narratives from the experiences of those on registries and their loved ones, Horowitz reveals the social impact and cycle of violence that results from dehumanizing and banishing those who have already been held accountable. From Rage to Reason offers a new perspective on how and why false claims about sex offenses became so pervasive and how these myths fostered ineffective policies that have little to do with the reality of most sexual abuse. It argues that to truly prevent sexual abuse, we must unearth the sources of these misunderstandings, debunk these claims in a systematic way, and have frank and genuine discussions about the limits of legal responses to complex social problems.

Available in PDF, EPUB and Kindle. Book excerpt: Applied ethics has been gaining wide attention in a variety of curriculums, and there is growing awareness of the need for ethical training in general. Well-publicized ethical problems such as the Challenger disaster, the Ford Pinto case and the collapse of corporations such as Enron have highlighted the need to rethink the role of ethics in the workplace. The concept of applied ethics originated in medicine with a groundbreaking book published in 1979. Business ethics books began to appear in the 1980s, with engineering ethics following in the 1990s. This volume now opens up a new area of applied ethics, comprehensively addressing the ethical issues confronting the civil aviation industry. Aviation is unique in two major ways: firstly it has a long history of government regulations, and secondly its primary focus is the safety of its passengers and crew. For decades commercial aviation was viewed in the same manner as public utilities, and thus it was highly regulated by the government. Since the Deregulation Act of 1978, aviation has been viewed as any other business while other experts continue to believe that the sudden switch to deregulation has caused problems, especially since many airlines were unprepared for the change. Ethical Issues in Aviation focuses on current concerns and trends, to reflect the changes that have occurred in this deregulated era. The book provides the reader with an overview of the major themes in civil aviation ethics. It begins with theoretical frameworks, followed by sections on the business side of aviation, employee responsibility, diversity in aviation, ground issues regarding airports, air traffic control and security, as well as health and the environment. The contributors to the volume include both academics doing research in the field as well as professionals who provide accounts of the ethical situations that arise in the workplace.
