Available in PDF, EPUB and Kindle. Book excerpt: This book by the ETUI Transnational Trade Union Rights Expert Network analyses enforcement as a key element making EU labour law effective or ineffective. Enforcement is the key ingredient that makes rights effective and ensures compliance. It can make or break a legal system. Despite this, enforcement of EU labour law has received little scholarly attention in recent decades and has rarely been examined in a comprehensive way. This book aims to fill this gap. Intended for academics and practitioners alike, the book adopts a threefold approach to examine this issue. First of all, it explores the idea of effective enforcement and sets out the wider context in which EU labour law enforcement takes place. Secondly, it analyses how enforcement operates in particular areas, including non-discrimination, health and safety, information and consultation rights, and the rights of migrating workers. Thirdly, it critically assesses the role of specific actors (in particular collective actors like trade unions, as well as whistle-blowers and the European Labour Authority) and settings (public procurement, economic and monetary policy) regulated by EU law. Drawing on the insights produced by these analyses, the book concludes by proposing a comprehensive Draft for a Model Directive on 'Effective Enforcement of EU Labour Law' as an inspiration for policy development and scholarly debate in this area.

The EU legislation governing the formation and operation of such companies also stipulates the need for employee involvement, in the form of information, consultation and participation. This report uses 10 company case studies and a review of legislation and literature to examine the current state of play regarding SEs and the nature and extent of employee involvement in them."--Editor.

Available in PDF, EPUB and Kindle. Book excerpt: This collective volume on quality of work in the European Union offers a comprehensive analysis on the current situation of the tensions between work and welfare in Europe, with a special emphasis on employment-related issues. The volume tackles a crucial aspect of employment policies, namely the strengthening of the quality dimension in the decisions taken by policy-makers to foster the performance of the labour market and to combine this orientation with the demands of workers for welfare, protection and a better reconciliation of work and family life. Quality of work has been on the agenda of policy-makers, practitioners and academics for the last few years, promoting a wide debate. The book provides a contribution to this debate and takes into consideration a range of issues associated with the analysis of work quality from an innovative perspective. Relevant subtopics including a conceptual and political analysis of work quality, wage differentials and in-work poverty, gender issues or workers' direct and indirect representation in the firm and its relation with work quality are addressed.

Are there significant differences between countries and sectors? What impact has the European Company had on business practice? Has it improved company mobility and flexibility? What impact has it had on national industrial relations systems and Social Europe? To what extent has it inspired other legislative initiatives by the EU Commission? What will the likely future development of the European Company be?

This handbook aims to ensure that the new opportunities for employee representation at European level which these new SE rules provide, are seized. It has been designed first and foremost to help practitioners to prepare and conduct negotiations on agreements on employee involvement in SEs. The handbook introduces the SE and its mechanism of employee involvement. It explains the negotiation procedures and provides ‘tips and tricks’ for a decent preparation of negotiations. Based on the experience of several experts, it gives an overview of key aspects of an SE agreement and includes an extensive set of overviews, graphics and comparative tables.

Book excerpt: The eighteen essays in this volume concentrate on the issues surrounding workers' participation, the area of industrial relations uppermost in Marco Biagi's thinking at the time of his assassination in March 2002. The trend toward ever greater employee involvement in managerial decisionmaking has been growing in Europe for over a decade, to a significant extent as a result of Biagi's work. From the start, he clearly discerned that the key to quality of work was worker participation. This book stands not merely as a homage, but as evidence that Biagi's assassination will not affect the progress he was making. In what amounts to an integrated series of recommendations for further European legislation on workers' participation in industrial relations, the authors analyse and evaluate the following: experience gained from implementation of the European Works Council Directive and the European Company Statute Directive; implications of the new Directive on Information/Consultation in National Undertakings and of the European Forum on the Financial Participation of Workers; and experience in a variety of national contexts, including those of Japan, Italy, France, Belgium, the United Kingdom, Germany, Russia, Poland, and Slovenia. In the final analysis, employee involvement--when it is a genuine commitment on the part of all stakeholders--is seen as a sharing of cultural values that successfully reconciles efficiency and social justice. Those who believe this is a goal worth achieving, for reasons both economic and social, will recognize in this book an immensely valuable contribution.

Available in PDF, EPUB and Kindle. Book excerpt: Involvement of employees in the social dialogue has always been an ongoing and vigorous concern of the European Union. Over the years since the European Works Councils (EWCs) were established in 1994, expectations regarding their role have grown, particularly in anticipating and managing change as corporate activities have become increasingly internationalized. Finally, after fifteen years of ongoing debate, Directive 2009/28/EC, establishing a new legal framework for EWCs, took effect in June 2009, with Member States obligated to implement the new rules at national level by June 2011. The 2009 Directive is intended to ensure that employees' transnational information and consultation rights are effective, to increase the number of European Works Councils established, to strengthen the legal certainty of negotiated outcomes involving EWCs, and to ensure that the directives on information and consultation of employees are better linked. This essential guide is the first publication to annotate and analyze the new Directive. It describes the many changes from the previous Council Directive 94/45/EC, and expertly traces the legislative history through all the intervening preparatory documents. It examines the most important provisions in depth, shedding clear light on such issues as the following: - the new definitions of 'information' and 'consultation'; - the nature of the stronger links between national and transnational levels of employee information and consultation; - employers' obligation to pass on information to local representatives of employees; - training of EWC members; - the composition of the Special Negotiating Body (SNB); - the presence of experts, including trade union representatives, in negotiation meetings; - employee representatives' right to collectively represent the employees; - the role of EWCs and workers' representatives in the EU's merger control procedures; - fall-back rules that improve EWCs' consultation in case of restructuring; and - provisions ensuring that EWCs are informed and consulted without calling into question the company's capacity to adapt. The author's insightful perspectives - e.g., on how the courts are likely to interpret such phrases as "rights arising from the directive" in specific contexts - add greatly to the practical value of the analysis. Annexes include virtually all relevant primary documents, encompassing pronouncements of the Commission, the Parliament, the social partners, and the European Economic and Social Committee. Beyond a doubt, this timely bulletin is essential reading for representatives of multinational enterprises operating in the EU, labour law and industrial relations scholars, representatives of trade unions and employers' associations, human resources professionals, lawyers negotiating EWC agreements, and concerned policymakers and government officials.

Few studies have looked at the operation of ECWs, partly because of the sheer novelty of the institution and the expense of conducting in-depth empirical research. In the first stage of this work, formal and quantitative data was obtained on ECWs via questionnaires and secondary data on the companies themselves. The second stage consisted of interviews with EWE representatives, management representatives, national trade union and employers association reps and the corresponding European trade union federations. These included interviews with representatives of the European Trade Union Confederation, the European Commission and the European Parliament

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the prospects for the emergence of a distinctly European pattern of industrial relations, in which the European-level organisations representing employers and trade unions gain in importance vis-a-vis their national organisations. In particular, the impact of the 'Social Chapter' to the Maastricht Treaty is considered. The study also considers the likelihood of European-level collective bargaining, and what effect mandatory European Works Councils might have on existing national systems of employee representation, and offers a trilateral comparison between industrial relations in Europe, North America and Japan.
