Available in PDF, EPUB and Kindle. Book excerpt: Russia’s annexation of Crimea and involvement in the conflict in eastern Ukraine has in many respects set back post-Cold War improved relations between Russia, the United States, and Europe. The continued war in Syria threatens the security and stability of many countries in the Middle East and attacks by ISIS and other terrorist organizations are causing increased fear and instability in Iraq and in neighbouring countries. In many areas negotiations on disarmament and arms control are at a standstill. In Disarmament under International Law, John Kierulf examines and discusses how disarmament, arms control, and non-proliferation of both conventional weapons and weapons of mass destruction are regulated in existing treaties and conventions. From his perspective as a former disarmament negotiator, Kierulf explains the United Nations’ disarmament machinery and procedures, and describes the UN’s essential role in promoting disarmament. Underlining the continued and serious threat posed by nuclear weapons, Kierulf appeals for increased and effective international efforts to reduce their number and ultimately eliminate them. Presenting information and analysis on a comprehensive range of issues, Disarmament under International Law is an essential guide for anyone interested in gaining knowledge about the current state of international security.

It critically reviews international law governing nuclear weapons with regard to the inter-state use of force, international humanitarian law, human rights law, disarmament law, and environmental law, and discusses where relevant the International Court of Justice's 1996 Advisory Opinion. Unique in its approach, it draws upon contributions from expert legal scholars and international law practitioners who have worked with conventional and non-conventional arms control and disarmament issues. As a result, this book embraces academic consideration of legal questions within the context of broader political debates about the status of nuclear weapons under international law.

Available in PDF, EPUB and Kindle. Book excerpt: Disarmament is integral to the safeguarding and promotion of security, development, and human rights. Hundreds of millions of dollars are spent each year on disarmament operations, yet no comprehensive guide exists to explain clearly the international rules governing disarmament. This book seeks to fill that gap. It describes the international legal rules that govern disarmament and the operational, political, and technical considerations that govern their implementation. This book aims to support compliance, implementation, and further development of international disarmament law. Traditionally, disarmament focused on weapons of mass destruction. This remains a critically important area of work. In recent decades, the scope of disarmament has broadened to encompass also conventional weapons, including through the adoption of rules and regulations to govern arms transfers and measures to eliminate specific munitions from stockpiles and to destroy explosive remnants of war. There have also been four "generations" of programmes to address small arms and light weapons at national or sub-national level through disarmament, demobilisation, and reintegration (DDR) programmes during and following the end of armed conflict. While an internationally accepted definition of disarmament does not yet exist, it is widely agreed that disarmament encompasses or interrelates with prohibitions and restrictions on the development, production, stockpiling, testing, and transfer of weapons and on their destruction. In addition to clarifying these elements, chapters of this guide will also consider the relationship between disarmament and the law of armed conflict, and with the United Nations Security Council, human security, public health, and non-state actors.

Book excerpt: This volume features a selection of the best scholarship on international law as it is relevant to the proliferation of weapons of mass destruction. The essays consider the nonproliferation legal regime as a normative system and offer a more discrete consideration of international law in each weapons of mass destruction technology area. The role, authority and track record of the UN Security Council in this area are also evaluated.

Book excerpt: The volume discusses the legal interpretation and implementation of the three pillars of the Treaty of the Non-Proliferation of Nuclear Weapons, 1968, regarding the non-proliferation of nuclear weapons; the right to develop research, production and use of nuclear energy for peaceful purposes; and issues relating to nuclear disarmament. It examines the status of international law regarding nuclear capacity, considering competing legal approaches to the development of nuclear technology, non-proliferation, disarmament and regulating nuclear weapons within a contemporary international context.

Available in PDF, EPUB and Kindle. Book excerpt: The spread of weapons of mass destruction poses one of the greatest threats to international peace and security in modern times--the specter of nuclear, chemical, and biological weapons looms over relations among many countries. The September 11 tragedy and other terrorist attacks have been painful warnings about gaps in nonproliferation policies and regimes, specifically with regard to nonstate actors. In this volume, experts in nonproliferation studies examine challenges faced by the international community and propose directions for national and international policy making and lawmaking. The first group of essays outlines the primary threats posed by WMD proliferation and terrorism. Essays in the second section analyze existing treaties and other normative regimes, including the Nuclear Non-Proliferation Treaty and the Chemical Weapons and Biological Weapons Conventions, and recommend ways to address the challenges to their effectiveness. Essays in part three examine the shift some states have made away from nonproliferation treaties and regimes toward more forceful and proactive policies of counterproliferation, such as the Proliferation Security Initiative, which coordinates efforts to search and seize suspect shipments of WMD-related materials.

Available in PDF, EPUB and Kindle. Book excerpt: President Bush outlined a specific plan to counter weapons of mass destruction (WMD) proliferation in his National Strategy to Combat Weapons of Mass Destruction of Dec., 2002. The Admin.'s plan combined efforts aimed at counterproliferation, nonproliferation, and WMD consequence management. The intent, it said, was to eliminate or "roll back" WMD in the possession of certain States and terrorist groups, including potentially the use of force and aggressive methods of interdiction of WMD-related goods, technologies, and expertise. The Proliferation Security Initiative (PSI), which would involve cooperation among friendly nations to interdict transfers of restricted weapons and related technologies "at sea, in the air, and on land." Aspects of this national security strategy raise questions related to the international law of jurisdiction, the law of the sea (which also references airspace), and international civil aviation agreements. Contents of this report: Introduction; Weapons of Mass Destruction International Legal Regime; Jurisdiction under International Law; The Law of the Sea; Enforcement Options; Conclusion. Appendix: Interdiction Principles for the Proliferation Security Initiative. This is a print on demand report.
