Book Synopsis The Use of Preventive Detention Laws in Malaysia: A Case for Reform by : M. Ehteshamul Bari
Download or read book The Use of Preventive Detention Laws in Malaysia: A Case for Reform written by M. Ehteshamul Bari and published by Springer Nature. This book was released on 2020-07-07 with total page 139 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the extraordinary nature of the power of preventive detention, which permits executive dispensation of the personal liberty of an individual on the mere apprehension that, if free and unfettered, he may commit acts prejudicial to national security or public order. In light of the extraordinary scope of this power, it, therefore, contends that the scope of the power should be confined to genuine emergencies threatening the life of the nation. Against the above background, this book sheds light on the fact that Article 149 of the Federal Constitution of Malaysia empowers the Parliament to enact preventive detention laws authorizing the executive branch of government to preventively detain individuals without the precondition of an emergency. Furthermore, the Constitution does not stipulate adequate safeguards for mitigating the harshness of preventive detention laws. This book makes it manifestly evident that the weaknesses of the constitutional provisions concerning preventive detention have enabled succeeding generations of executives in Malaysia to not only enact a series of preventive detention statues for arrogating to themselves wide powers concerning preventive detention but also to rely on them for arbitrarily detaining their political adversaries. Consequently, on the basis of this analysis, this book puts forward concrete recommendations for insertion in the Constitution detailed norms providing for legal limits on the wide power of the executive concerning preventive detention. The insertion of such norms would ensure the maintenance of a delicate balance between protecting national interests and, simultaneously, observing respect for an individual’s right to protection from arbitrary deprivation of liberty. This book is useful for academics and students of comparative constitutional law, human rights and Asian law. The extensive law reform analysis undertaken in this book also greatly benefits the policy makers in Malaysia and the policy makers of constitutional polities facing similar problems with the issue of circumscribing the scope of the powers concerning preventive detention.

Book Synopsis The ASEAN Intergovernmental Commission on Human Rights by : Hsien-Li Tan
Download or read book The ASEAN Intergovernmental Commission on Human Rights written by Hsien-Li Tan and published by Cambridge University Press. This book was released on 2011-07-07 with total page 323 pages. Available in PDF, EPUB and Kindle. Book excerpt: This assessment of progress in Southeast Asia on human rights begins in the wake of the 'Asian values' debate and culminates in the formal regional institutionalisation of the ASEAN Intergovernmental Commission on Human Rights (AICHR). Chapters examine the arduous negotiation of AICHR, the evolving relationship between ASEAN states' and the international human rights system, and the historical and experiential reasons for hesitancy. The text concludes with a discussion of how the evolving right to development impacts upon AICHR and international human rights in general, and how their preference for economic, social and development rights could help ASEAN states shape the debate.

Book Synopsis Small Powers and Trading Security by : Michael Intal Magcamit
Download or read book Small Powers and Trading Security written by Michael Intal Magcamit and published by Springer. This book was released on 2016-12-08 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines why and how small powers link their security interests and trade agendas, and how security threats influence the facilitation and outcome of their trade activities. In doing so, it analyses the increasingly complex connections between trade and security, demonstrating how these linkages affect the overall security of four small but important states in East Asia. Focusing on the role of high levels of internal and external insecurities, marginal geo-economic size and peripheral geopolitical position, and multidimensional and multidirectional security contexts and threats, the author concludes that for every security enhancement that a linkage creates a consequent security risk is generated. In other words, Taiwan, Singapore, Malaysia, and the Philippines are effectively trading their security. This innovative book will appeal to political scientists, economists, and security and trade experts.

Book Synopsis Mahathir’s Islam by : Sven Schottmann
Download or read book Mahathir’s Islam written by Sven Schottmann and published by University of Hawaii Press. This book was released on 2018-09-30 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mahathir Mohamad’s legacy as Malaysia’s longest serving prime minister (1981–2003) is deeply controversial. His engagement with Islam, the religion of just over half Malaysia’s population, has often been dismissed as partisan maneuvering. Yet his willingness to countenance a more prominent place for Islam in government and society is what distinguished him from other modernist politicians, and his instinct to set Malaysian politics against the backdrop of the wider Muslim world was politically astute. Author Sven Schottmann argues that Mahathir’s transformative effect on Malaysia can only be fully appreciated if we also take him seriously as one of the postcolonial Muslim world’s most significant political thought leaders. Schottmann sees Mahathir’s representations of Islam as a relatively coherent discourse that can legitimately be described as “Mahathir’s Islam.” This discourse contains Mahathir’s assessment of the economic, political, and sociocultural problems facing the contemporary Muslim world and the range of solutions and corrective measures that he proposed Muslims should adopt. His ideas are fraught with flaws and contradictions. On the one hand, he emphasized the individualistic, egalitarian, pluralistic, democratic, and dynamic qualities of Islam. On the other, his government enacted legislation and acquiesced in the activities of religious bodies that curtailed religious freedoms of both Muslims and non-Muslims. His ideas contributed to Malaysia’s worsening state of interethnic relations, yet his insistence that every Muslim had the right to speak for Islam may have, paradoxically, prepared the ground for a future democratization of Malaysian politics. Mahathir’s Islam is based on rigorous analysis of Mahathir’s speeches, interviews, and writings, which the author is able to link to parallel processes elsewhere in the Muslim world—Indonesia, the Middle East, Pakistan, Turkey, and diaspora communities in the West. Mahathir’s Islamic discourse, Schottmann suggests, must be read against the wider late twentieth-century resurgence of religion in general, and the post-1970s Islamic revival in particular. Balanced in approach and engagingly written, this book will be of interest to scholars and students of political science, religious studies, and others interested in Malaysia, Southeast Asia, or Mahathir himself.
