Available in PDF, EPUB and Kindle. Book excerpt: Analyzing the structures of transnational organized crime, this book considers whether traditional mechanisms and national jurisdictions can tackle this increasing menace. Highlighting the strengths and weaknesses in the present methods of control, the book discusses the possibilities of developing more effective national and international strategies, the creation of non-legal mechanisms outside the traditional criminal justice system and the implications of 'disruption strategies'. The roles of law enforcement officers, tax investigators, financial intelligence officers, compliance officers, lawyers and accountants - in enforcing both civil and criminal sanctions on organized crime - are also considered.

Available in PDF, EPUB and Kindle. Book excerpt: The Palgrave Handbook of Criminal and Terrorism Financing Law focuses on how criminal and terrorist assets pose significant and unrelenting threats to the integrity, security, and stability of contemporary societies. In response to the funds generated by or for organised crime and transnational terrorism, strategies have been elaborated at national, regional, and international levels for laws, organisations and procedures, and economic systems. Reflecting on these strands, this handbook brings together leading experts from different jurisdictions across Europe, America, Asia, and Africa and from different disciplines, including law, criminology, political science, international studies, and business. The authors examine the institutional and legal responses, set within the context of both policy and practice, with a view to critiquing these actions on the grounds of effective delivery and compliance with legality and rights. In addition, the book draws upon the experiences of the many senior practitioners and policy-makers who participated in the research project which was funded by a major Arts and Humanities Research Council grant. This comprehensive collection is a must-read for academics and practitioners alike with an interest in money laundering, terrorism financing, security, and international relations.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a normative analysis of the justifications and limits of asset confiscation as a crime control measure in a comparative perspective. More specifically, it deals with what in this context is referred to as extended appropriation, that is, confiscation in cases where the causal link between the property (the proceeds of crime) in question and the predicate offence(s) is less obvious. Particular focus is placed on extended criminal confiscation and civil recovery. These forms of confiscation give rise to a number of complex legal issues. The overarching purpose of the book is to provide an analysis of the nature of extended appropriation within the criminal justice system and to discuss a normative framework that may assist in assessing the legitimacy of such confiscation schemes. It also seeks to explore what a fair and reasonable balance between the interests of the state and those of the individual in this field might look like. The analysis starts from an acknowledgement not only of the need for having effective confiscation regimes in place, but also of the need for protecting the interests of the individual. It is hoped that the book will stimulate further discussion on the legitimacy of asset recovery as a crime control measure.

Book excerpt: This collection of essays explores the continuities and disruptions in the perceptions of criminality, its causes and ways of fighting it in late imperial Russia and the early Soviet Union. It focuses on both the discourse on criminality and thus the conceptualisation of criminality in various disciplines (criminology, psychiatry, and literature), and penal practice, that is, different aspects of criminal law and anti-crime policy. Thus, the volume is markedly interdisciplinary, with authors representing a variety of approaches in history and literary studies, from social history to discourse analysis, from the history of sciences to text analysis.

Book excerpt: The 1959 Chinese military takeover of Tibet brought an end to a unique way of life in which Buddhism provided legitimacy to political and social authority in Tibet and served as value system, cultural bond, philosophy of life, and framework for a complex political and social order. The religious-political system of Tibet now exists only in the memories of those who experienced it. This book documents the human heritage and cultural traditions of Tibet's singular society as they developed and existed during a period of several hundred years. Using Max Weber's framework of the interrelationship between religious ideologies and the emergence of social, economic, and political systems, Franz Michael and his colleagues analyze the concepts that are central to Tibetan Buddhism and apply them to the Tibetan people, their social and political order, and their way of life. Much of the study is based on interviews with Tibetans in exile-from incarnations and highly placed ecclesiastical and secular government leaders to farmers, herdsmen, and housewives. The result is important not only as the record of a culture, but also as it is related by the authors to the broader issue of the modernization of non-Western traditional societies.

Available in PDF, EPUB and Kindle. Book excerpt: This paper outlines the Government's proposals for reform of policing, with a move away from bureaucracy towards more democratic accountability. There will be directly elected Police and Crime Commissioners, representing their communities and understanding their crime and anti-social behaviour priorities. They will hold chief constables to account for achieving them, and will be able to fire her or him if they do not. Chief constables will be responsible for the day to day operations of their police force but accountable to the public via these individuals and not Whitehall. Regular beat meetings will allow people to challenge the police's performance and accessible 'street level' crime data will shine a light on local crime trends and concerns. Central targets will be abolished, and the police will be encouraged to use their professional judgment in performing their job. The Government will create a new National Crime Agency to lead the fight against organised crime, protect the borders and provide services best delivered at national level.
