For the would-be practitioner, that poses certain problems. Divorce mediation cannot provide a long history of generally accepted procedures. Nor is there even a body of information to which would-be practitioners can turn for instruction or guidance. And, of course, there are no established schools that can train or prepare a practitioner to do this work. To make matters worse, the situation is likely to remain in this state for some time to come. Given this fact, it was felt that it would be useful for practitioners (even for those already engaged in divorce mediation) to have a handbook which would trace a typical mediation from its inception to its conclusion and which would provide them with the substantive informa tion they need to know in order to do divorce mediation. It is hoped that this handbook will fill this need. Having said that, however, it must be acknowledged that the purpose of this book is very much beyond that. Until now, divorce mediation in the United States has been shaped principally by such books as O. J. Using insights about markets from the new institutional economics, this book sheds light on the institutional history of the emissions trading concept as it has evolved across different contexts. It makes accessible the policy design and practical implementation aspects of a key tool for fighting climate change: emissions trading systems (ETS) for environmental control. Blas Luis Pérez Henríquez analyzes past market-based environmental programs to extract lessons for the future of ETS. He follows the development of the emissions trading concept as it evolved in the United States and was later applied in the multinational European Emissions Trading System and in sub-national programs in the United States such as the Regional Greenhouse Gas Initiative (RGGI) and California’s ETS. This ex-post evaluation of an ETS as it evolves in real time in the real world provides a valuable supplement to what is already known from theoretical arguments and simulation studies about the advantages and disadvantages of the market strategy. Political cycles and political debate over the use of markets for environmental control make any form of climate policy extremely contentious. Pérez Henríquez argues that, despite ideological disagreements, the ETS approach, or, more popularly, 'cap-and-trade' policy design, remains the best hope for a cost-effective policy to reduce GHG emissions around the world.

In this process of convergence between competition and public procurement law , the need for this joint study is clearly apparent. As such the book asks whether competition law principles inform or condition public procurement rules, and whether they are adequate to ensure that competition is not distorted in markets where public procurement is particularly significant. The book moves away from the classical focus of public procurement on the activities of private actors, developing instead an analytical framework for the appraisal of the market behaviour of the public buyer from a competition perspective. The analysis is both legal and economic. Proceeding through a careful assessment of the general rules of competition and public procurement, the book constantly tests the efficacy of the rules in competition and public procurement against a standard of the proper functioning of undistorted competition in the market for public procurement.

Yet, it has also been criticized for engaging in judicial activism, restricting national regulatory autonomy, and taking away the powers of Member State institutions. In recent years, the Court appears to afford greater deference to domestic actors in free movement cases. Europe's Passive Virtues explores the scope of and reasons for this phenomenon. It enquires into the decision-making latitude given to the Member States through two doctrines: the margin of appreciation and decentralized judicial review. At the heart of the book lies an original empirical study of the European Court's free movement jurisprudence from 1974 to 2013. The analysis examines how frequently and under which circumstances the Court defers to national authorities. The results suggest that free movement law has substantially changed over the past four decades. The Court is leaving a growing range of decisions in the hands of national law-makers and judges, a trend that affects the level of scrutiny applied to Member State action, the division of powers between the European and national judiciary, and ultimately the nature of the internal market. The book argues that these new-found 'passive virtues' are linked to a series of broader political, constitutional, and institutional developments that have taken place in the EU.

Labor Market Policies in Canada and Latin America: Challenges of the New Millennium reviews the evidence of Canada and Latin America on three major labor policy instruments - unemployment insurance, minimum wages and training - and on the effects of the payroll taxes which are the main means of funding the unemployment insurance system and other components of social expenditure. This is the first study attempting an in-depth comparison of these labor policy instruments between Canada and Latin America. The useful juxtaposition of Canadian and Latin American experiences comes at a time when the trend in Canada is to back away from the perhaps overly generous or ineffectively administered elements of the labor legislation/social security net and when Latin American countries have undertaken significant reforms of their past systems but require further changes to move toward the sorts of legislation and support systems that characterize developed countries. Despite such attention, students' educational opportunities have remained persistently unequal as understandings of the goals underlying schooling, fundamental changes in educational governance, and the definition of an equal education have continually shifted. Drawing from law, education policy, history and political science, this book examines how the concept of equality in education law and policy has transformed from Brown through the Stimulus, the major factors influencing this transformation, and the significant problems that school reforms accordingly continue to face.
