Grosso modo, possiamo dire che i primi sei paragrafi del testo sono dedicati all’esposizione dei contenuti del d.lgs. n. 28/2010, quindi all’analisi del procedimento di mediazione, mentre i paragrafi da 7 a 11 trattano maggiormente le disposizioni del d.m. 180/2010, quindi la disciplina delle spese della mediazione, quella degli organismi di mediazione e quella degli enti di formazione per i mediatori. Inoltre, nei capitoli 12, 13, 14, 15 e 16 sono contenuti degli approfondimenti su quattro problematiche che questa disciplina pone: quella della responsabilità civile per il fatto illecito commesso dal mediatore o dall’organismo di mediazione a danno di una o di entrambe le parti nel corso procedimento finalizzato alla conciliazione di una controversia; quella degli effetti che essa ha sulle procedure conciliative per le controversie in materia bancaria e finanziaria gestite da organismi creati dal sistema bancario prima dell’emanazione del d.lgs. n. 28/2010; quella del suo impatto sul tentativo obbligatorio di conciliazione previsto dall’art. 10 della legge n. 192 del 1998 per le controversie derivanti dai contratti di subfornitura; quella sulla mediazione per le controversie sui contratti di multiproprietà e su quelli relativi ai prodotti per le vacanze di lungo termine definiti dall’articolo 69 del Codice del consumo riformato dall’art. 2 del d.lgs. n. 79/2011.

Book excerpt: This book investigates the actions of marriage tribunals by analyzing the richest source of marriage suits extant in Italy, those of the Venetian ecclesiastical tribunal, between 1420 and the opening of the Council of Trent. It offers a strongly representative overview of the changes the Council introduced to centuries-old marriage practices, relegating it to the realm of marginality and deviance and nearly erasing the memory of it altogether. From the eleventh century onward, the Church assured itself of a jurisdictional monopoly over the matter of marriage, operating both in concert and in conflict with secular authorities by virtue of marriage’s civil consequences, the first of which regarded the legitimacy of children. Secular tribunals were responsible for patrimonial matters between spouses, though the Church at times inserted itself into these matters either directly, by substituting itself for the secular authority, or indirectly, by influencing Rulings through their own sentences. Lay magistratures, for their part, somewhat eroded the authority of ecclesiastical tribunals by continuing to exercise autonomous jurisdiction over marriage, especially regarding separation and crimes strictly connected to the nuptial bond and its definition, including adultery, bigamy, and rape.

Book excerpt: Dealing with the aftermath of civil conflict or the fall of a repressive government continues to trouble countries throughout the world. Whereas much of the 1990s was occupied with debates concerning the relative merits of criminal prosecutions and truth commissions, by the end of the decade a consensus emerged that this either/or approach was inappropriate and unnecessary. A second generation of transitional justice experiences have stressed both truth and justice and recognize that a single method may inadequately serve societies rebuilding after conflict or dictatorship. Based on studies in ten countries, this book analyzes how some combine multiple institutions, others experiment with community-level initiatives that draw on traditional law and culture, whilst others combine internal actions with transnational or international ones. The authors argue that transitional justice efforts must also consider the challenges to legitimacy and local ownership emerging after external military intervention or occupation.
