Book excerpt: Con questo testo offriamo una ristampa del Codex Iuris Canonici promulgato da Benedetto XV nel 1917 e rimasto in vigore fino al 1983 quando venne sostituito da Giovanni Paolo II col nuovo codice di diritto canonico.Prima della promulgazione del Codex Iuris Canonici del 1917, il diritto canonico era regolato dal Corpus Iuris Canonici, insieme dei provvedimenti canonici ufficiali della Chiesa.Data la molteplicità e dispersione delle fonti, delle deroghe, delle abrogazioni e correzioni introdotte lungo i secoli, e inoltre dall'inattualità e inutilità di non poche disposizioni, vi era molta incertezza quanto al diritto. Così nacque maturò vivo il desiderio di avere una sola legge organica e ben strutturata.Durante il Concilio Vaticano I (1869-1870) alcuni vescovi chiesero chi una revisione, chi una nuova collezione o un nuovo codice. La sospensione del Concilio e urgenze contingenti di carattere storico-politico fecero cadere temporaneamente nel nulla tale richiesta.Tale questione fu ripresa in mano da Papa Pio X con il Motu Proprio Arduum sane munus (19 marzo 1904): con esso veniva istituita un'apposita commissione cardinalizia con l'incarico di redigere il nuovo Codice. La commissione venne affiancata da un collegio consultorio e dalla collaborazione dell'episcopato dell'ecumene cattolica.Il Codice in lingua latina sarebbe dovuto essere costituito da canoni brevi e chiari e si sarebbe basato sul Corpus Iuris Canonicis, sul Concilio di Trento, sugli atti pontifici, sui decreti delle congregazioni romane e sugli atti dei tribunali ecclesiastici.Tra il 1912 e il 1914 un primo progetto fu inviato ai vescovi dell'ecumene cattolica di rito latino per le dovute osservazioni.Pio X però senza vedere la conclusione di questa prima opera preparatoria che venne ripresa e conclusa nel 1916 sotto Papa Benedetto XV.Papa Benedetto XV (1914-1922) promulgò il Codex Iuris Canonici con la costituzione apostolica Providentissima Mater Ecclesia (27 maggio 1917), ed entrò in vigore il 19 maggio 1918.Il Codice riguardava esclusivamente la Chiesa Latina, non vincolando i fedeli di altro rito se non per disposizioni in materia di fede, morale e precetti di diritto divino.Con lo stesso Motu Proprio Benedetto XV diede vita anche al Pontificium Consilium Codicis Iuris Canonici Authentice Interpretando ("Pontificia Commissione per l'Interpretazione Autentica del Codice di Diritto Canonico"), nato con lo scopo di rispondere in maniera autorevole ai quesiti che sarebbero nati sul codice, per renderne una interpretazione autentica.Il Codice è rimasto in vigore fino al 1983, anno della promulgazione del nuovo Codice di diritto canonico, a cui fece seguito poi il Codice dei Canoni delle Chiese Orientali.

The Declaration Dignitatis Humanae developed this opinion of the individual as dignified (DH 2) and as a person equipped with his or her own sense of conscience (DH 3). Based on this form of dialogical thinking, the Council can tolerate varying forms of Christianity other than the Catholic form and accept other religions or beliefs. These positions reflect two focal points of his research: on the one hand Church history and Canon Law, on the other hand classical and particularly medieval Roman law and their history. They matched very felicitously his engagement for and in the Old-Catholic Church. The contributions centre on the themes and questions the honorand has pursued in his work till now.

Book excerpt: Within ecclesiastical circles, both from the perspective of legal practice and ordinary relational matters between ecclesiastical entities, the theme of contract very scarcely occupies a place of prominence. It is a situation that is due on the one hand, and to a large extent, to the fact that the canonisation of civil law on contracts (c. 1290 CIC/1983) has had the consequence of transferring the preoccupation of the entities on this matter to the domain of civil law. Besides, and still connected to the above, is the tendency to attribute a merely pastoral relevance to their relationships, with little or no reference to the juridic aspects inherent in these relationships. It is a situation that is largely responsible for the crisis which do not uncommonly characterise some of these relationships as verified over the centuries; particularly in the relationship between dioceses and religious institutes. The issuance of various papal and conciliar exhortations before and after Vatican II, as well as the normative instructions and legal provisions contained in various juridic documents, most prominently cc. 271, 520, 681 and 790 of CIC/1983, has gone a long way to dissipate some of the tensions of the past. However, the true nature of how the contractual relationship between ecclesiastical entities, including the attendant issues of conceptual understanding, civil status of ecclesiastical entities, resolution of contractual disputes, etc., remains a matter of investigative interest for the canonist. This is, in a nutshell, the substance of this research work. The conclusions arrived at offer the reader an insight into the available untapped resources within the ecclesiastical legal system, as well as some considerable possibilities which remain to be explored to the benefit of the subjects of canon law.
