From these conclusions the 109th Congress revised federal emergency management policies vested in the President; reorganized the Federal Emergency Management Agency (FEMA); and enhanced and clarified the mission, functions, and authorities of the agency, as well as those of its parent, the Department of Homeland Security (DHS).

In its 2006 work on the response to Hurricane Katrina, GAO noted that these elements needed to be strengthened. In October 2006, Congress enacted the Post-Katrina Act to address issues identified in the response to Hurricane Katrina. GAO reported in November 2008 that the Department of Homeland Security (DHS) and the Federal Emergency Management Agency (FEMA) had at least preliminary efforts under way to address most of the provisions, but also identified a number of areas that required further action. Book excerpt: Hurricane Katrina struck the Gulf coasts of Louisiana, Alabama, and Mississippi on August 29, 2005, resulting in severe and widespread damage to the region. The response of the federal government, especially the Federal Emergency Management Agency (FEMA), in the aftermath of the storm has been widely criticized. Some of the criticism has focused on the organizational arrangements involving FEMA and its parent, the Department of Homeland Security (DHS). One month prior to the hurricane, in July 2005, Secretary of Homeland Security Michael Chertoff announced plans for a reorganization of DHS, including FEMA. Known as the "Second Stage Review," or "2SR," the reorganization transferred emergency preparedness functions from FEMA to a new Preparedness Directorate, among other changes. The Administration began implementation of the reorganization on October 1, 2005. In response to Administration requests, congressional support for the proposal was provided through approval of the FY2006 appropriations legislation. In the aftermath of the Katrina disaster, administrative structure issues remain a matter of contention. Pending legislation before Congress (H.R. 3656, H.R. 3659, H.R. 3816, H.R. 3685, H.R. 4009, H.R. 4493, S. 1615, S. 2302, H.R. 4840, H.R. 5316, and H.R. 5351) would make further changes. The release of reports by the House, Senate, and White House on the response to Hurricane Katrina may lead to further examination of the issues. This report provides background information on the establishment and evolution of federal emergency management organizational arrangements since the end of World War II and briefly summarizes the legislative proposals. Category 4 and category 5 hurricanes will, according to most predictions, become both more frequent and more intense in the future due to global warming and/or natural weather cycles. In addition, it is often said that another terrorist attack on the United States is inevitable; that it is a question of when, not whether. Add to that the scare over a possible avian flu pandemic. As a result, the United States should expect that disaster response—to natural and other types of disasters—will continue to be of vital concern to the American public and the policymakers and officials who deal with disaster response and relief, including the military. The U.S. disaster relief program reflects a basic division of responsibility between federal, state, and local governments that has generally stood the test of time. At the federal level, a single agency, FEMA—now under the Department of Homeland Security—has been charged with the responsibility for coordinating the activities of the various federal agencies that have a role in disaster relief. A successful disaster response requires three things: timely and effective coordination between state and federal governments; effective coordination among the federal agencies; and effective coordination between and among state and local government agencies. Miskel, a former Deputy Assistant Associate Director of FEMA, examines the effects that operational failures after Hurricanes Agnes, Hugo, Andrew, and Katrina have had on the organizational design and operating principles of the disaster response system program. He also discusses the impact of 9/11 and the evolving role of the military, and he identifies reforms that should be implemented to improve the nation's ability to respond in the future.
