Book excerpt: This article examines the level of appropriate level of constitutional protection against outside governments that condemn property located within a given local municipality that use tax increment financing to fund local improvements The standard TIF arrangement does not provide the TIF lenders with liens against any particular asset, because to do so would be to abandon the tax exempt status of the municipal bonds that are issued. Yet these agreements guarantee that the local government that issued the bonds will take no steps to compromise their repayment from (incremental) tax dollars. These protections allow TIF bonds to trade in ordinary financial markets. The bonds may, however, prove vulnerable to loss when the private and public property within the local municipal district are condemned by an outside governments, as happened in Chicago v. Prologis, now before the Illinois Supreme Court. I believe that these TIF bonds should in general be counted as property under the takings clause and not be treated as a mere 'expectation' devoid of constitutional protection. This topic opens the way for a larger consideration of how to value divided interests in real property under the takings clause as a matter of modern finance theory in light of the powerful public choice issues at stake.

The states were chosen not so much to represent distinct differences in treatment of TIF across the U.S., but rather to demonstrate a sampling across different geographic regions, among small and large states, urban and rural. The chapter authors describing the experiences in the states report on: - the income stream tapped for the tax increment; - the form of long-term project financing, usually in the form of bonds; - the need for urban redevelopment as part of the TIF package; - the presence or need for a plan; and - the presence or need for public participation. To conclude this examination of the state of the law, the final chapter is an updated version of an article that first appeared in the law review for the ABA Section of State and Local Government Law, The Urban Lawyer. The article examines how state courts have construed TIF bonds in light of constitutional limits on borrowing, a subject that is important but not easily treated in sufficient depth in the state chapters we included.

Book excerpt: This report finds that the Government's desire to deliver localism is neither supported consistently across Whitehall nor implemented coherently by each department of state. MPs warn that the Minister for Decentralisation will need to bring coherence, rigour and clear priorities to the Government's programme. The MPs call for a more explicit statement about where the dividing line will be drawn between a central, light-touch framework for local services and unwarranted interference from ministers in local affairs. So far the Government has shown itself all too eager to impose its preferences on local decision-making. Ministers have also introduced policies that circumvent rather than empower local government: elected police commissioners, free schools, academies and health service reform, threaten to fragment rather than integrate delivery of better public services at local level. As devolution proceeds, the manner in which local decisions are taken come under greater scrutiny. Any reduction in the inspection and performance management required by Whitehall must be accompanied by stronger local democratic accountability. Broadening the provider base for public services is an important plank of the government's decentralisation agenda, but it remains unclear how far the 'Big Society' can expand to take on services and functions shed by statutory bodies. Localism should not be adopted purely as a way to curb public sector costs not least because the financial benefits of more tailored services may not offset the loss of efficiencies of scale. Stimulating greater democratic participation and civic activism will itself cost money if it is to be successful and sustainable.
