This book was released on 2013-10-11 with total page 108 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee on Human Rights accepts the need for a counter-terrorism power to stop, question and search travellers at ports and airports without reasonable suspicion, but calls for a reasonable suspicion threshold to be introduced for the more intrusive powers such as detention, searching and copying the contents of personal electronic devices like mobile phones and laptops, and taking biometric samples. The Committee welcomes the improvements made to the powers in Schedule 7 of the Terrorism Act 2000 to stop, question, search and detain at ports, but still considers that a number of significant human rights compatibility concerns remain with those powers even after the changes have been made. The Committee recommends a number of other amendments to the Bill with regards to preventive measures against anti-social behaviour. Whilst cautiously welcoming the Bill's provision to criminalise forced marriage, the Committee believes the new law must be implemented and monitored carefully to ensure that it is not counter-productive for victims. The Committee also recommends additional measures to protect against the potential for prolonged retention of DNA and other personal samples in criminal investigations.

This book was released on 2012-12-19 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report calls on the Government to widen the scope of a proposed new adoption measure. The Government's proposed 'fostering for adoption' duty is designed to encourage councils to place looked after children with foster carers who can then go on to adopt them, providing continuity and stability. The scope should be extended by creating a duty to consider a fostering for adoption placement for all children for whom adoption is the plan. The Committee does not find it necessary to remove any requirement to give consideration to ethnicity but recommends an alternative amendment to the legislation which accords ethnicity an equal place within the list of the child's needs and characteristics. Other recommendations from the Committee include: a wider application of the principles behind concurrent planning, which places children with prospective adopters while at the same time actively exploring rehabilitation to the birth family; earlier and more robust decision-making by social workers in establishing when rehabilitation with the birth family is no longer an option; a review of the Statutory Guidance on Adoption to ensure permanency planning is given serious consideration one month after a child enters care

Book excerpt: In this report the Committee describes and explains the full range of its work over the course of the 2001-2005 Parliament. The Committee distils from its experience a number of suggestions for consideration by its successor committee and recommendations addressed to the Government, in order to enhance the integration of human rights considerations into the overall policy and legislative process. Chapter 2 explains the background to the Committee's establishment. Chapter 3 covers the legislative scrutiny performed by the Committee. The monitoring of the implementation of the Human Rights Act is the subject of chapter 4, while chapter 5 covers work in relation to institutional support for human rights within the UK. The inquiries into the international treaties to which the UK is a party are dealt with in chapter 6, including the Convention on the Rights of the Child, the International Covenant on Economic Social and Cultural Rights, and the Convention on the Elimination of Racial Discrimination. The final chapter describes the work undertaken on monitoring action taken by the Government in response to incompatibilities with Convention rights, arising from Strasbourg judgments and declarations of incompatibility by UK courts.

Download or read book Children Bill written by Great Britain: Parliament: Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2004 with total page 136 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's report examines the Children Bill as introduced into the Commons in July 2004 (HCB 144, ISBN 0215704479), following Lords amendments. In particular, the report focuses on the parts of the Bill relating to: the creation of the post of Children's Commissioner for England; strengthening the legal framework of co-operation between agencies delivering children's services; as well as clause 49 of the Bill on the corporal punishment of children and the restriction of the defence of 'reasonable chastisement', in light of the UK's obligations under the UN Convention on the Rights of the Child and the European Convention on Human Rights. Conclusions reached include i) support for the creation of an independent rights-based office of Children's Commissioner; and ii) that the continuing availability of the defence of reasonable chastisement is incompatible with the UK's obligations under the UN Convention and other international agreements.

Book Synopsis The International Covenant on Economic, Social and Cultural Rights by : Great Britain. Parliament. Joint Committee on Human Rights
Download or read book The International Covenant on Economic, Social and Cultural Rights written by Great Britain. Parliament. Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2004 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee on Human Rights examined the implementation of the UN International Covenant on Economic, Social and Cultural Rights in the UK. Domestic legislation protects many of the economic, social and cultural rights, with the Covenant itself having little impact in UK domestic law. The Committee believes that there is scope for incorporating further protection of rights in the UK, by enshrining some of the guarantees contained in the Covenant. Further, that for the Covenant rights to be effective, they should be part of a framework for government policy development, and that Government along with the Commission for Equality and Human Rights should develop ways of measuring the progress of these rights. The Committee also recommends, that explanatory notes to Bills, should include discussion of the Bills compatibility with Covenant rights, which is a way of enhancing the scrutiny of proposed Government legislation. Furthermore, the Committee recommends the introduction of an Equality Bill, to address the concerns of discrimination faced by ethnic minorities and persons with disabilities in employment, housing and education.
