Book excerpt: Excerpt from A History of the Court of Chancery: With Practical Remarks on the Recent Commission, Report, and Evidence, and on the Means of Improving the Administration of Justice in the English Courts of Equity When'we enter Upon the municipal law of any country, in its present state, we resemble a traveller, 'who crossing the Delta, loses his way among the numberless branches of the Egyptian river. But when we begin at the source, and follow the current of the law, it is in that course not less easy than agreeable; and all its relations and dependancies are traced with no greater difficulty, than are the many streams into which that magnificent river is divided before it is lost in the sea. Under the direction of this guide the writer of the following pages began 'to explore the hidden sources of English Law, and the origin of the Equity jurisdiction; but when he early discovered that mr. Hargrave and mr. Maddock had contemplated a History of the Court of Chancery, and that with all the advan. This book was released on 2016-05-23 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judicial equity developed in England during the medieval period, providing an alternative access to justice for cases that the rigid structures of the common law could not accommodate. Where the common law was constrained by precedent and strict procedural and substantive rules, equity relied on principles of natural justice - or 'conscience' - to decide cases and right wrongs. Overseen by the Lord Chancellor, equity became one of the twin pillars of the English legal system with the Court of Chancery playing an ever greater role in the legal life of the nation. Yet, whilst the Chancery was commonly - and still sometimes is - referred to as a 'court of conscience', there is remarkably little consensus about what this actually means, or indeed whose conscience is under discussion. This study tackles the difficult subject of the place of conscience in the development of English equity during a crucial period of legal history. Addressing the notion of conscience as a juristic principle in the Court of Chancery during the sixteenth and seventeenth centuries, the book explores how the concept was understood and how it figured in legal judgment. Drawing upon both legal and broader cultural materials, it explains how that understanding differed from modern notions and how it might have been more consistent with criteria we commonly associate with objective legal judgement than the modern, more 'subjective', concept of conscience. The study culminates with an examination of the chancellorship of Lord Nottingham (1673-82), who, because of his efforts to transform equity from a jurisdiction associated with discretion into one based on rules, is conventionally regarded as the father of modern, 'systematic' equity. From a broader perspective, this study can be seen as a contribution to the enduring discussion of the relationship between 'formal' accounts of law, which see it as systems of rules, and less formal accounts, which try to make room for intuitive moral or prudential reasoning.

Book excerpt: Excerpt from An Historical Sketch of the Equitable Jurisdiction of the Court of Chancery: Being the Yorke Prize Essay of the University of Cambridge for 1889 I have derived much assistance from Spence and from the introductions and essays referred to above, and, as regards the history of the court, and of the Chancellors who presided over it, from Parkes' History of the Court of Chancery and Lord Campbell's Lives of the Chancellors, and for the materials of the 12th chapter, on the growth of modern equity, I have drawn largely upon the stores collected in White and Tudor's Leading Cases. My indebtedness to these and the other works and authorities of which I have made use is fully acknowledged in the notes. I have added, in the notes to the 12th chapter, some references, (printed in heavy type) to recent cases in which the principles summarised in the text have been discussed and illustrated, in the hope that, with their assistance, the account of the leading cases and of the doctrines established by them given in that chapter may be useful as a first introduction to a study of modern equity. The majority of the recent cases are taken from Brett's Leading Cases in M odern Equity, where the facts of, and extracts from the judgments in the cases are set out, and I am indebted to Mr Brett and his publishers for permission kindly accorded to me, to make use of his valuable collection. I have to thank my friend Mr A. Wood Renton for his kindness in reading the proof sheets of the essay. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
