Book excerpt: Excerpt from Historical Introduction to the Roman Law The facts that another edition of this book has been called for, and that the second edition has been trans lated into Portuguese indicate that it makes an appeal to students who are attending lectures upon the Institutes. It does not pretend to be a systematic history of the Roman law, nor is it intended in any way to take the place of a commentary on the Institutes of Justinian. It is rather a series of chapters on problems, mainly historical, which confront the student who is beginning the Roman law. Its aim is to be complementary to a course of lectures, and to supply a historical background. The historical notices contained in the Institutes of Justinian are so fragmentary that without more information the student does not see the law in its true perspective. He has to be reminded that the law of Justinian is the culmination of a long history, and that the Romans started with a little body of Aryan customs, out of which their extraordinary genius was able by slow degrees to shape a legal system of the greatest refinement. Originally the law of a small rural community, then of a powerful city-state, it became the law of an empire which embraced almost all of the known civilized world. The influence of Roman law extends into modern times and is reflected in the great codifications of private law that have come into existence in Europe, America, and Asia. Even now, Roman law in modified form is the law of the land in Scotland, and the civil code of Louisiana is directly based on Roman law. Forming an important part in the historical and intellectual background of understanding and a basis for further development of the principles of international jurisprudence. In this book an international authority on Roman legal history sets forth in clear, understandable English the institutions of Roman law and traces their development through the Byzantine Empire into medieval and modern Europe. It is an indispensable study for every American lawyer and for anyone interesting in legal and political history.

They arranged law in three groups - (i) law concerning per sons; (2) law concerning things; and (3) law concerning actions. Practically they sub divided 'things' into - (i) property; (2) obligation (3) inheritance. Inheritance' is discussed in the Institutes after property, ' and before 'obligation'; but it is more convenient to take it after obligation.' As the present work is intended to serve as a companion to the Institutes of Justinian, the arrangement of justinian has been, with that exception, substantially followed. In this Edition a Supplementary Glossary explaining the technical terms and phrases employed in the Institutes will, it is hoped, prove convenient and useful to students. Unfortunately the pressure of other subjects renders it impossible for most students to make a detailed study of the history of Roman law. If the "introduction" is not to encroach upon the time assigned to the practical law it must be kept within narrow limits. The difficulty is largely one of selection. Book excerpt: Excerpt from Introduction to Roman Law: In Twelve Academical Lectures The author of this preface was intrusted with the office of carrying these lectures through the press. They were so completely ready, that hardly an expres sion or even a word needed correction, and so plainly written that the printer could have no excuse for mis taking a letter. As calculated to initiate young stu dents into the mysteries of Roman law, to diffuse a just idea of its preciseness of definition, and to broaden the foundation of legal study, they seem to me to pos sess peculiar merit. The index to this volume was prepared by Prof Albert S. Wheeler, late of Cornell University. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from A Manual of the Principles of Roman Law Relating to Persons, Property, and Obligations: With a Historical Introduction There are already in existence so many works upon Roman Law of the highest erudition and authority that it seems necessary to offer some explanation of the appearance of the present volume. The purpose of this work is somewhat special. Far from seeking either to place itself alongside of, or to enter into rivalry with, the already recognised authorities upon the subject, it seeks rather to present the results of their critical erudition in a form and in terms free from technicalities, and to expound the main principles of the matured Roman Law relating specially to Persons, Property, and Obligations, but excluding the Law of Succession and Actions, in so far as these are the foundation of modern legal science, in a manner that does not involve as a pre-requisite a knowledge of the Latin language. In this respect the present work seeks to be an introduction to the study of law that will be available to the interested layman no less than to the would-be lawyer. By means of a succinct Historical Introduction, and throughout the text, it has been sought to indicate the course of the development of the Roman legal institutions and principles, a knowledge of which is essential to the true appreciation of any legal system. This work has been prompted as the result of the experience obtained by the author during a number of years in lecturing to Egyptian students. The Egyptian Native Codes being based, in very large measure, upon the French Codes, a knowledge of the principles of Roman Law is essential to the student of law in Egypt, who, however, suffers from the disadvantage that he has no knowledge of the Latin language. While it is, therefore, impossible to expound the subject to him either directly or by way of commentary upon the Latin texts, it is, at the same time, necessary to present to the student, in language that will be readily understood, a statement of the main principles of the Roman Law in such a manner as will both compensate for his lack of a classical education and do fair justice to the subject. With this object in view, the subject is here expounded by a method of divisions and sub-divisions, each of which is, as far as possible, self-contained; on which account, indeed, there may appear to be, at times, somewhat of redundancy. Book excerpt: Excerpt from The First Year of Roman Law I have made in this summary work no claim to erudition, but I have applied to it great solicitude for exactness and modernness of doctrine. If I have thought it proper to indicate authorities almost paragraph by paragraph, it is because I had need of preserving myself from any involuntary error. It is also because I have provided for the case where some student should make use of my little book as an index, or as a bibliography easy to consult.
