In this study, economists, lawyers, and sociologists evaluate an institutional form that is new to American society and, indeed, to the world--the public interest law (PIL) organization. The book introduces the reader to the structure, resources, and activities of this "nonprofit industry," and also to the factors that affect PIL firms in their choices of cases and methods of handling them. The authors examine PIL's vast range of contemporary public policy concerns. These incude such general topics as the environment, consumerism, housing, employment discrimination, medical care, occupational health and safety, education finance, and taxation. A number of base studies are presented, and a method for economic analysis and evaluation is introduced and applied. The study points to PIL's success in advocating under-represented interests, in winning courtroom decisions, and in translating legal victories into reallocations of resources. At the same time, it notes the bias of PIL towards test-case litigation, a propensity to focus on judicial victories rather than on real social change, and a tendency to use lawyers even when other types of professionals might be more effective. Many of these problems stem from uncertainty of funding and legal restrictions on "nonprofit" organizations. The result is a set of hurdles that distracts PIL firms from their principal goals. The authors do not limit themselves to PIL, but comment on the effectiveness of legal instruments as devices for social change, and on the behavior of the voluntary nonprofit sector, a little-studied portion of the economy. The book presents a fresh approach to the study of both collective-type economic problems and institutional setting in which public interest law works. First, it is a good example of something all too rare in sociology: testing competing general theories. Most of us either try to develop or refine theories about how the social world works, and cite convenient data as support, or we select and collect data that will fit some general theoretical position. In the first case, the data playa subor dinate role-bits of evidence for our view of life. In the second, the theory plays a subordinate role-a way to make sense of the social behavior we have observed. McCaffrey's position subsumes these two. He has gathered data on an important social agency, but with an im plicit problem in mind: which of the several theories about the social world he was exposed to in graduate school would do the best job of interpreting the data? Or, we might just as well turn it around. In a graduate department such as Sociology at the State University of New York at Stony Brook, there is a lively, never ending debate about the "truth" of competing perspectives on the political and social world. By selecting a data base and remaining alert to the kind of evidence each theory required, McCaffrey circumvented the usual" data for a theory" vs. "a theory for the data" dilemma that most of us live with.

Under the guise of reforming the health care system, the Clinton plan would have herded almost all Americans under age sixty-five into large, government-sponsored health insurance purchasing alliances that would have contracted with insurers to offer a standard set of benefits at regulated prices. The plan came under fire from both Republicans and Democrats, including moderates from both parties, but it soon became apparent that what doomed it was a public unwilling to trust government to manage their health care. The critical literature has failed to offer a cogent analysis of why government control of health care does not work. American Health Care delivers that analysis.
