Existing approaches to waste siting facilities have almost entirely failed, across all industrialized countries, largely because of community or NIMBY (Not in My Backyard) opposition. This volume examines a new strategy, voluntary choice siting--a process requiring mutual decisions negotiated between facility developers and the host communities. This bottom-up approach preserves democratic rights, recognizes the importance of public perceptions, and addresses issues of equity. In this collection, an interdisciplinary group of experts probes recent examples of waste facilities siting in the United States, Canada, Germany, and Japan. Both the successes and the failures presented offer practical insights into the siting process. The book includes an introductory review of the literature on facility siting and the NIMBY phenomenon as well as instructive essays on the use of voluntary processes in facilities siting. Having included the UK as a country where decision processes were far less participatory (and thus ‘worse’ in my own view) than those in the Netherlands, I started doing my first interviews there, which were mainly intended to identify suitable case studies for research. But then I read a highly critical review of a book that had a similar topic as my study. The critique was that cases of hazardous waste siting cannot adequately be studied without understanding their national context. This made me decide to devote some attention to the legal context of hazardous waste siting in the three countries of interest (which is of course only a part of the national context) and its development through the years. The study of the UK system of environmental regulation and land use planning was not a simple issue, and I was warned various times (for instance by Andrew Blowers at the Open University) that the legislation was highly complex and easily misinterpreted. I felt personally touched by such warnings and decided that I should perhaps approach the UK system a bit less as an evil empire and maybe be a bit more ‘objective’ in my appraisals.

Book excerpt: This book explores siting dilemmas - situations in which an "authority" (e.g., Congress, a consortium of utilities) deems it in the best interest of society to build a facility such as an incinerator, but opponents living near the proposed site thwart the plan. Facility developers typically attribute local opposition to selfishness or radically inaccurate views of the risks posed by the facility. We examine the validity of these conclusions by looking in depth at the psychological response that arises when residents are faced with the prospect of living near waste disposal facilities. The particular siting dilemma considered in this book is the problem of how to "dispose" of the high-level nuclear wastes accumulating at nuclear power plants in the United States. These wastes, in the form of "spent" fuel rods, will emit dangerous levels of radioactivity for thousands of years - anywhere between 10,000 and 100,000 years, depending on the margin of safety one adopts. The current proposal is to encase the spent fuel in corrosion-resistant canisters and then to bury these canisters deep underground in a geologic repository. The two of us became involved with the high-level waste issue in 1986 as part of an interdisciplinary research team hired by the State of Nevada. The charge of this team was to estimate the socioeconomic impacts that would accompany a repository if it were built at Yucca Mountain, approximately 100 miles northwest of Las Vegas.

It presents a uniquely exploration of environmental governance from this hitherto under-researched perspective, and simultaneously, in order to provide a better conceptual understanding, examines the different theories of federalism and modes of distribution of powers, authorities and functions. Given their symmetrical federal experiences, India and Canada naturally qualify as the domain of study, with both being known as twin federal nations. Issues of environment have been factorised and classified according to their critical significance in terms of policy choices. The combinatorial structure has been evaluated in terms of better federal management of environment. In the process, many new dimensions of federalism and environment have emerged, which may contribute to the critical mass of knowledge on the subject. This book makes a departure from the general mono-construction of the environment as a restricted unit of knowledge available only to a specialist. Broadly following an interdisciplinary logic of formation of idea, this study is highly relevant in generating a new perspective on environmental research. It defines environment as a system which requires careful redrafting and reworking of three structures of relationships, namely between man and environment, between resource community and the state, and between inter-governmental contestations.

Gerrard, who has represented dozens of municipalities and community groups that have fought landfills and incinerators, as well as companies seeking permits, clearly and succinctly analyzes a problem that has generated a tremendous amount of political conflict, emotional anguish, and transaction costs. He proposes a new system of waste disposal that involves local control, state responsibility, and national allocation to deal comprehensively with multiple waste streams. Gerrard draws on the literature of law, economics, political science, and other disciplines to analyze the domestic and international origins of wastes and their disposal patterns. Based on a study of the many failures and few successes of past siting efforts, he identifies the mistaken assumptions and policy blunders that have helped doom siting efforts. Gerrard first describes the different kinds of nonradioactive and radioactive wastes and how each is generated and disposed of. He explains historical and current siting decisions and considers the effects of the current mechanisms for making those decisions (including the hidden economics and psychology of the siting process). He outlines a new alternative for facility siting that combines a political solution and a legal framework for implementation.
