Available in PDF, EPUB and Kindle. Book excerpt: This book presents both a new theoretical framework for the criminalisation of hate, referred to as “law as social justice liberalism”, and a comprehensive analysis of hate crime laws that have been enacted globally. The book begins by reflecting back on 30 years of theorisation on hate crime laws, arguing that there has been a failure to adequately capture the distinct harms of hate-based criminal conduct within legal frameworks. The book posits that liberal societies interested in advancing social equality ought to expand conventional paradigms of harm used in criminal law by comprehending hate-based conduct as a form of social injustice. Drawing on the work of Iris Young, the book sets out a comprehensive analysis of the harms of hate crime as a form of group-based oppression and uses this to set out criteria for the inclusion of protected characteristics under legislation. The second half of the book presents findings from a comparative study of hate crime laws enacted in 190 different legal jurisdictions. This includes a new taxonomy of types, models and legal tests used by legislatures to capture the myriad forms of hate-based criminal conduct that occur globally. Further evaluation of case law and empirical research on the application of these diverging legislative approaches is used to provide recommendations on how legislators ought to construct hate crime laws. The book completes its analysis of law as social justice liberalism by synthesising law, punishment and restorative justice as a means of ensuring that liberal systems of “justice” are more firmly anchored to the advancement of “social justice”.

Available in PDF, EPUB and Kindle. Book excerpt: Boston entered the twentieth century as an Irish Catholic city, no longer the "Yankee" town of its Puritan past. The dominance of the Irish Catholic population, swelled by the "potato famine" masses, gave it political control of the city, and significantly, control of its public schools. Unlike in other American cities, Boston Catholics had little need for a large or influential parochial system: they had the School Committee, school principals, and the teachers. In Irish vs. Yankees, James W. Sanders takes a new look at this critical period in the development of Boston schools, from 1822, when Boston officially became a city, to the Second World War. Framing the discussion around the Catholic hierarchy, he considers the interplay of social forces in the nineteenth and early twentieth centuries that led to the political rise of the Irish Catholic over the native Brahmin and the way this development shaped Boston's schools. From Bishop John Fitzpatrick to Boston College, Sanders introduces a cast of colorful characters and institutions to this tale of the education and religion in one of America's most prominent cities.

Available in PDF, EPUB and Kindle. Book excerpt: The UK’s Changing Democracy presents a uniquely democratic perspective on all aspects of UK politics, at the centre in Westminster and Whitehall, and in all the devolved nations. The 2016 referendum vote to leave the EU marked a turning point in the UK’s political system. In the previous two decades, the country had undergone a series of democratic reforms, during which it seemed to evolve into a more typical European liberal democracy. The establishment of a Supreme Court, adoption of the Human Rights Act, Scottish, Welsh and Northern Irish devolution, proportional electoral systems, executive mayors and the growth in multi-party competition all marked profound changes to the British political tradition. Brexit may now bring some of these developments to a juddering halt. The UK’s previous ‘exceptionalism’ from European patterns looks certain to continue indefinitely. ‘Taking back control’ of regulations, trade, immigration and much more is the biggest change in UK governance for half a century. It has already produced enduring crises for the party system, Parliament and the core executive, with uniquely contested governance over critical issues, and a rapidly changing political landscape. Other recent trends are no less fast-moving, such as the revival of two-party dominance in England, the re-creation of some mass membership parties and the disruptive challenges of social media. In this context, an in-depth assessment of the quality of the UK’s democracy is essential. Each of the 2018 Democratic Audit’s 37 short chapters starts with clear criteria for what democracy requires in that part of the nation’s political life and outlines key recent developments before a SWOT analysis (of strengths, weaknesses, opportunities and threats) crystallises the current situation. A small number of core issues are then explored in more depth. Set against the global rise of debased semi-democracies, the book’s approach returns our focus firmly to the big issues around the quality and sustainability of the UK’s liberal democracy.

Available in PDF, EPUB and Kindle. Book excerpt: By the mid nineteenth century, anti-Catholicism had become a central conflict in America. Fueling the dissent were Protestant groups dedicated to maintaining what they understood to be the Christian vision and spirit of the "founding fathers." Afraid of the religious and moral impact of Catholics, they advocated for stricter laws in order to maintain the Protestant predominance of America. Of particular concern to some of these native-born citizens, or "nativists," were Roman Catholic immigrants whose increasing presence and perceived allegiance to the pope alarmed them. The Nativist Movement in American History draws attention to the religious dimensions of nativism. Concentrating on the mid-nineteenth century and examining the anti-Catholic violence that erupted along the East Coast, Katie Oxx historicizes the burning of an Ursuline convent in Charlestown, Massachusetts, the Bible Riots in Philadelphia, and the theft and destruction of the "Pope's Stone" in Washington, D.C. In a concise narrative, together with trial transcripts and newspaper articles, poems, and personal narratives, the author introduces the nativist movement to students, illuminating the history of exclusion and these formative clashes between religious groups.
