Ignoradas, cuando no deformadas bajo una mirada interesadamente sexista, ellas han permanecido al margen de la evolución de las ideas acerca de la criminalidad y su definición, como seres natural y socialmente conformes. Concebido el delito como masculino, su desviación tenía que ser interpretada como signo de una anormalidad individual, fruto de disfunciones y patologías propias de su sexo, o de una socialización frustrada en los roles normativos de género destinados a asegurar su vinculación al espacio privado y a los dictados de una domesticidad y una pasividad impuestas. Desde el feminismo se hacía imprescindible elaborar un nuevo saber criminológico destinado a ofrecer un marco ideológico crítico con esa realidad simplista y exasperante, empeñada en una explicación ahistórica de la trasgresión femenina, sin referencia a las características estructurales de la sociedad y la cultura en que las mujeres están insertas, como si fueran seres excluidos del orden social y simples víctimas de una jerarquía sexual imposible de desafiar. Las páginas de este libro se proponen recorrer las trayectorias marcadas por ese pensamiento crítico para investigar, en nuestra realidad penal y penitenciaria, acerca de posibles procesos selectivos de criminalización que sitúen a las mujeres en una posición de desventaja y de discriminación que una criminología feminista deba desvelar, poniendo remedio a una ignorancia que dura ya demasiado tiempo. María Luisa Maqueda Abreu es Catedrática de Derecho Penal de la Universidad de Granada. Desde el año 1998 ha realizado investigaciones relacionadas con la violencia contra las mujeres, en particular, sobre malos tratos, tráfico, explotación sexual y prostitución. Ha participado asimismo en diversos proyectos de investigación relacionados con el género, la multiculturalidad y los colectivos en los márgenes (2005, 2010, 2012). Entre sus publicaciones más recientes sobre esos temas destacan: Prostitución femenina y control: una relación controvertida (1998); La violencia de género: entre el concepto jurídico y la realidad social (2006);¿Es la estrategia penal una solución a la violencia contra las mujeres?: algunas propuestas desde un discurso feminista crítico (2007); Prostitución, feminismos y derecho penal (2009). A propósito de la trata y de las razones que llevan a confundir a l@s inmigrantes con esclav@s (2009); 1989/2009: veinte años de “desencuentros” entre la ley penal y la realidad de la violencia contra las mujeres (2010); La trata sexual de mujeres: entre mitos y realidades (2011); El peso del género y otras identidades culturales en la criminalización de las mujeres (2014). Otras líneas de investigación recientes se orientan hacia materias de política criminal y criminología relacionadas con la expansión del control del delito y los jóvenes de la calle. Entre ellas: Políticas de seguridad y Estado de Derecho (2004); La expansión del control y la hipocresía de las leyes penales (2008); Aproximación a la violencia juvenil colectiva desde una criminología crítica (bandas, tribus y otros grupos de calle) (2010). En la actualidad trabaja sobre criminalización del espacio público.

She deals with studies of prostitution and rape and considers the treatment of women – as offenders and victims – by the criminal law, the police and courts, and the penal system. Particular attention is given to the question of lenient treatment for female offenders with the conclusion that women and girls are, in some important instances, actually discriminated against in our legal and penal systems. The relationship between female criminality and mental illness is discussed and the author concludes by dealing with some of the problems inherent in developing a feminist criminology.
