After arguing that Habermas's Discourse Theory of Law and Democracy is too normative and idealistic, it presents Foucault's Discourse Theory of Power Relations to illustrate the tensions between different Western discourse theories. The book then draws on the normative concept of Confucian Rationality from traditional Chinese cultural sources in order to investigate how adaptable these two discourse theories are to the Chinese society, and to balance the tension between them. Presenting these three dimensions of discourse theory, as well as the relations between them, it also uses empirical descriptions of certain facts of political-legal discussion both in traditional China and in the country's new media age to explain, supplement and question this theoretic framework. The book asserts that, because of the diverse modes of thinking in specific cultures, there might be different normative paradigms of discorse and different political-legal discussion modes across corresponding cultural contexts. Normative discourse theories provide guidance for the practices of deliberative democracy and legal discussions, which can in turn verify, supplement, improve and challenge the normative discourse theories. In addition to demonstrating the multiple dimensions of discourse theories, this research also promotes an approach to the Discourse Theory of Law and Democracy that combines elements of both Chinese and modern society. .

However, an increasingly open economy is creating the infrastructure for an open society, with the rise of a non-state sector in which a private economy, non-governmental organizations (NGOs) and different forms of social forces are playing an increasingly powerful role in facilitating political change and promoting good governance. This book examines the development of the non-state sector and NGOs in China since the onset of reform in the late 1970s. It explores the major issues facing the non-state sector in China today, assesses the institutional barriers that are faced by its developing civil society, and compares China’s example with wider international experience. It shows how the ‘get-rich-quick’ ethos of the Deng Xiaoping and Jiang Zemin years, that prioritised rapid GDP growth above all else, has given way under the Jiantao Hu regime to a renewed concern with social reforms, in areas such as welfare, medical care, education, and public transportation. It demonstrates how this change has led to encouragement by the Hu government of the development of the non-state sector as a means to perform regulatory functions and to achieve effective provision of public and social services. It explores the tension between the government’s desire to keep the NGOs as "helping hands’ rather than as autonomous, independent organizations, and their ability to perform these roles successfully.

It contends that these publics are chronic, although individually they are usually transient. They are networked, which enables them to go viral in hours, and they may engender unexpected consequences. These features explain why online public spheres survive in China even though censorship and information manipulation are pervasively and strategically maneuvered to guide or manufacture “public opinion”. The book also proposes that there are deeply entangled structural factors bolstering China's online news-prompted public spheres: the continuous flow of news information, the countless public spaces facilitated by China’s digital infrastructure and the rise of rights-conscious netizens. Pushing forward a new way of conceptualizing the idea of public spheres, this book contends clearly that public spheres are most often sparked by chronic news in today's media-saturated societies. Book excerpt: This book examines how critical approaches to security developed in Europe can be used to investigate a Chinese security issue - the case of the Falungong. The past few decades have produced a rich field of theoretical approaches to ‘security’ in Europe. In this book, the security-specific notions of securitization, the politics of insecurity, and emancipation are used as analytical approaches to investigate the anti-Falungong campaign in the People’s Republic of China. This campaign, launched in 1999, was the largest security-related propaganda campaign since 1989 and was directed against a group of qigong-practitioners who were presented as a grave threat to society. The campaign had major impacts as new security legislation was established and human rights organizations reported severe mistreatment of practitioners. This book approaches one empirical case with three approaches in order to transcend the tendency to pit one approach against another. It shows how they highlight different aspects in investigation, and how they can be combined to gain more comprehensive insights, and thereby invigorate renewed debate in the field. Furthermore, this is used as a vehicle to discuss more general philosophical issues of theory, development, and theory development and will assist students to comprehend the effects research framework selection has on a piece of research. Such discussions are necessary in order to apply the frameworks in investigations that go beyond the socio-political context they were originally developed in.
