Available in PDF, EPUB and Kindle. Book excerpt: The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.

It is a story of cultural identity and assimilation, of survivors from a course of events that destroyed millions of lives. Reinhard Bendix offers a profound and moving account of his father's life as a lawyer and critic of the German judicial system, his break with Judaism and identification with German culture, and his emigration to Palestine during Hitler's regime. Bendix then examines the relationship with his father and details his youth in Germany, his emigration to America, and his early career as a scholar.

Book excerpt: This book explores the impact of the First World War on Imperial Germany and examines military aspects of the conflict, as well as the diplomacy, politics, and industrial mobilization of wartime Germany. Including maps, tables, and illustrations, it also offers a rich portrait of life on the home front - the war's pervasive effects on rich and poor, men and women, young and old, farmers and city-dwellers, Protestants, Catholics, and Jews. It analyzes the growing burdens of war and the translation of hardship into political opposition. The new edition incorporates the latest scholarship and expands the coverage of military action outside Europe, military occupation, prisoners of war, and the memory of war. This survey represents the most comprehensive history of Germany during the First World War. It will be of interest to all students of German and European history, as well as the history of war and society.

Available in PDF, EPUB and Kindle. Book excerpt: This book introduces physics students and teachers to the historical development of the kinetic theory of gases, by providing a collection of the most important contributions by Clausius, Maxwell and Boltzmann, with introductory surveys explaining their significance. In addition, extracts from the works of Boyle, Newton, Mayer, Joule, Helmholtz, Kelvin and others show the historical context of ideas about gases, energy and irreversibility. In addition to five thematic essays connecting the classical kinetic theory with 20th century topics such as indeterminism and interatomic forces, there is an extensive international bibliography of historical commentaries on kinetic theory, thermodynamics, etc. published in the past four decades. The book will be useful to historians of science who need primary and secondary sources to be conveniently available for their own research and interpretation, along with the bibliography which makes it easier to learn what other historians have already done on this subject. Contents:The Nature of Gases and of Heat (Boyle, Newton, Bernoulli, Gregory, Mayer, Joule, von Helmholtz, Clausius, Maxwell)Irreversible Processes (Maxwell, Boltzmann, Thomson, Poincaré, Zermelo)Historical Discussions by Stephen G BrushA Guide to Historical Commentaries: Kinetic Theory of Gases, Thermodynamics, and Related Topics Readership: Graduate and research students, teachers, lecturers and historians of physics. The documentation on all of these makes this book a reference for those who are interested in the history of science and the theory of general relativity

Available in PDF, EPUB and Kindle. Book excerpt: Based upon the proceedings of the First International Conference on the History of General Relativity, held at Boston University's Osgood Hill Conference Center, North Andover, Massachusetts, 8-11 May 1986, this volume brings together essays by twelve prominent historians and philosophers of science and physicists. The topics range from the development of general relativity (John Norton, John Stachel) and its early reception (Carlo Cattani, Michelangelo De Maria, Anne Kox), through attempts to understand the physical implications of the theory (Jean Eisenstaedt, Peter Havas) and to quantize it (Peter G. Bergmann), to elaborations of the theory into a unified theory of electromagnetism and gravitation (Vladimir P. Vizgin, Michel Biezunski), and considerations of its cosmological extensions (Pierre Kerszberg, George F.R. Ellis). This is the first volume to survey many of the most important questions in the history of general relativity, with many of the contributions drawing upon such original resources as the Einstein Archive. It is hoped that it will stimulate much-needed further research in this hitherto neglected area.
