The Model Legislative Provisions translate into legislative language the advice given in the recommendations contained in the Legislative Guide. The Model Legislative Provisions are intended to assist in the establishment of a legislative framework favourable to public-private partnerships (PPPs). The Model Legislative Provisions follow the corresponding notes in the Legislative Guide, which offer an analytical introduction with references to financial, regulatory, legal, policy and other issues raised in the subject area. The user is advised to read the Model Legislative Provisions together with the Legislative Guide, which provide background information to enhance understanding of the legislative recommendations. The Model Legislative Provisions deal with matters that it is important to address in legislation specifically concerned with PPPs. They do not deal with other areas of law that, as discussed in the Legislative Guide, also have an impact on PPPs. Moreover, the successful implementation of PPPs typically requires various measures beyond the establishment of an appropriate legislative framework, such as adequate administrative structures and practices, organizational capability, technical expertise, appropriate human and financial resources and economic stability.

The conservation of the historic urban environment poses specific and urgent challenges that require a multidisciplinary approach in which conservation actions are embedded within economic, social, and environmental development strategies. Increasingly, the private and third sectors are playing a pivotal role in these processes. Public-private partnerships (PPPs) are contractual arrangements in which the private and/or third sector assists in delivering a public facility or service by providing funding or operating leadership. The third sector, which may include heritage-related NGOs, as well as people living near a heritage site, is of particular relevance to PPPs used for heritage conservation. This publication focuses specifically on the use of PPPs for historic buildings and historic urban areas, and is targeted to those working in the cultural heritage sector. It draws on existing literature, which it aims to make more accessible to those interested in cultural heritage conservation. While providing information on the basic concepts of public-private partnerships and the roles and responsibilities of the partners in a PPP, this is not a guide to the use of PPPs. It discusses the types of PPPs that have been used to conserve historic buildings and historic urban areas, provides specific examples of where and how they have been used, and demonstrates ways in which PPP mechanisms have met conservation goals. This publication also makes some limited observations on the aims of PPPs drawn from the literature, from published case studies, and from a few further case study investigations. This publication draws on English-language works produced between 1992 and 2012, but concentrates on the more recent literature. Much of this material is from the Australia, the United Kingdom, and other European nations that have been the most active in conducting PPPs for heritage resources and in publishing information about these projects. This overview includes an extensive bibliography and provides some suggestions of topics for further research.

But the way PPP are often implemented is in need of reform. The main needs are to increase legal certainty and the transparency and competitiveness of PPP procurement processes and to develop an approach which better fits the needs of the public sector for value for money. Yet objective advice for decision makers on when and how to use PPP effectively and how to create the right policy, legal and operational framework is hard to find. Cutting through the jargon and the misconceptions, this book is an independent guide for those facing these challenges at all levels in Europe. In particular, it aims to move beyond the mindset in which PPP is used as the default option for public investment projects without a pragmatic and rigorous assessment on a case by case basis. Written from a public sector perspective, this book has two main audiences in mind, i.e.: European decision makers responsible for creating an appropriate legal framework at EU level for PPP and wanting to understand the impact of European policy decisions on how PPP are used to implement them, Politicians and senior public officials at national level currently facing choices about when and how to use PPP and also how to remove administrative and legal barriers to using them. Finally, the book includes recommendations to improve the future use of PPP, aimed at better legislation, more effective policy making, more effective implementation of PPP and an enhanced role for auditors as the guardians of value for money. The recommendations add up to an agenda for reforming the implementation of PPP in Europe. It is an agenda which will need political will both at national and European level to implement, but it is one which, as the author argues, needs to be implemented to secure the future of PPP as an option available to policy makers responsible for delivering public services.
