L’analisi della valenza giuridica e l’interpretazione da dare all’applicazione di tutte le linee guida globalmente disponibili, non escludono la partecipazione attiva dell’uomo nella concreta attuabilità delle stesse, infatti è la persona del medico che le mette in atto con risultati a volte di vantaggio e altre di danno per il malato, ma sempre doverosamente guidato dal fine di apportare beneficio al paziente.

Gli associati ASLA hanno esaminato lo stato attuale della normativa in materia, la giurisprudenza di legittimità e metodo formatasi nel corso degli anni, le più recenti casistiche e pronunce di legittimità che riguardano i diversi profili della responsabilità civile dei professionisti interessati, degli ospedali e delle cliniche private. Il profilo relativo alla organizzazione del rischio, così come quello che riguarda l'aspetto della assicurazione della responsabilità, pur concernendo aspetti rispettivamente prodromici e successivi al sorgere della responsabilità civile degli operatori sanitari, è stato oggetto di attento esame. Non sfuggirà che alcuni degli aspetti principali che caratterizzano lo spirito dell'Associazione, in primis la cultura dell'organizzazione e l'innovazione, ha consentito ai professionisti che ne fanno parte e che hanno collaborato alla realizzazione dell'opera, di poter riconoscere la valenza della attuale legislazione in materia sanitaria ed il valore attribuito alla gestione del rischio e all'assicurazione della responsabilità civile. Non a caso, è preminente l'interesse di ASLA allo sviluppo dell'esercizio strutturato e innovativo della professione: dalla elaborazione delle linee di Best Practices (2010) alla certificazione di buona governance rilasciata agli Studi che hanno completato il percorso elaborato dall'Associazione con un'importante società di servizi per la certificazione (Professional Conduct Certified, 2016), fino alla realizzazione quale Ente promotore con UNI e Accredia delle prassi di riferimento, approvate il 30 Ottobre 2017, che costituiscono il presupposto per la certificazione di qualità ISO 9001/2015, la norma volontaria applicabile alla gestione ed al controllo dei rischi che possono derivare dall'esercizio dell'attività legale secondo tali modalità. Non di minore importanza l'evento organizzato a Milano il 18 Maggio 2018 Diritto al Futuro nel quale è stato affrontato tra i vari temi anche quello della rilevanza dell'innovazione tecnologica in una più attuale concezione e gestione dell'attività legale. E se di tali caratteristiche nello svolgimento delle professioni non si potrà più fare a meno, analoga considerazione è rispondente anche nell'esercizio e nell'assistenza sanitaria delle strutture pubbliche e private alla collettività. Il corretto utilizzo della prevenzione, analisi e limitazione dei rischi porterà il beneficio di cure più efficaci e sicure, oltre ad un contenimento della spesa pubblica nell'assistenza sanitaria.
