Book excerpt: A new model for effective global environmental governance in an era of human-caused planetary transformation and disruption. Humans are no longer spectators who need to adapt to their natural environment. Our impact on the earth has caused changes that are outside the range of natural variability and are equivalent to such major geological disruptions as ice ages. Some scientists argue that we have entered a new epoch in planetary history: the Anthropocene. In such an era of planet-wide transformation, we need a new model for planet-wide environmental politics. In this book, Frank Biermann proposes “earth system” governance as just such a new paradigm. Biermann offers both analytical and normative perspectives. He provides detailed analysis of global environmental politics in terms of five dimensions of effective governance: agency, particularly agency beyond that of state actors; architecture of governance, from local to global levels; accountability and legitimacy; equitable allocation of resources; and adaptiveness of governance systems. Biermann goes on to offer a wide range of policy proposals for future environmental governance and a revitalized United Nations, including the establishment of a World Environment Organization and a UN Sustainable Development Council, new mechanisms for strengthened representation of civil society and scientists in global decision making, innovative systems of qualified majority voting in multilateral negotiations, and novel institutions to protect those impacted by global change. Drawing on ten years of research, Biermann formulates earth system governance as an empirical reality and a political necessity.

Available in PDF, EPUB and Kindle. Book excerpt: This special issue of the Climate Policy journal addresses the following key questions: * What long-term range of policies for climate change adaptation and mitigation should Europe pursue to adequately enhance sustainability on a global level? * What are the implications of long-term European climate strategy for the design of a global post-2012 climate regime? * What are the key concerns of different stakeholders and how will these concerns impact on long-term climate policy? These questions were discussed during two workshops, commissioned by the European Forum on Integrated Environmental Assessment (EFIEA) and jointly organized by the National Institute of Public Health and the Environment (RIVM), The Netherlands and the Tyndall Centre for Climate Change Research, UK. Selected papers from these workshops were adapted and peer-reviewed for publication. International experts offer detailed policy analysis and review the links between policy and economics, sustainable development, technology and adaptation. Also included are introductory and concluding remarks from the guest editors, highlighting key points and offering an expert synthesis of the workshop discussions. This will be invaluable reading for professionals, researchers and academics interested in climate change and climate policy, policy makers, policy analysts, energy consultants, and representatives from industry planning their own long-term energy strategies.

Book excerpt: Between 2001 and 2002 the Maritime Institute of the Universiteit Gent and the Centre for International Law of the Vrije Universiteit Brussel joined efforts and hosted Emeritus Professor Dermott Devine as holder of the International Francqui Chair, around the central themes of fisheries and coastal state jurisdiction with respect to marine pollution. As Emeritus Director of the Institute of Marine and Environmental Law, Professor Devine was available for discussion and participation in the scientific life of the different Belgian universities having similar fields of interest. Within this context six classes of excellence were organized with the participation of interested Belgian colleagues across the board, belonging to universities adhering to different basic philosophies and even forming part of different linguistic communities. These classes culminated in a final symposium where Professor Devine gave a birds-eye view of the general theme, overarching and synthesizing the different subjects covered during the previous classes of excellence. This book offers a reworked compilation of all the contributions of the key-note speakers to the classes of excellence.

Available in PDF, EPUB and Kindle. Book excerpt: The international nature of the maritime industry means that ships are subject to the varying legal jurisdictions of the ports in which they call. Law and policy provide a framework necessary for establishing order and harmonization in a highly regulated global industry; they are vital instruments for promoting the safety, security, and commercial efficiency of shipping as well as the protection of the marine environment, in an atmosphere of competing national-contra-global as well as private-contra-public interests. Furthermore, it is of great importance that the legal and policy aspects of maritime activities closely follow the rapid pace of technological and commercial developments. Students and practitioners in maritime law and policy need to be constantly familiar with trends in the shipping industry and possess a solid comprehension of the international legal regimes that not only encourage the sustainable development of global maritime commerce, but also regulate its conduct. This book is a collection of essays dedicated to Professor Proshanto Kumar PK Mukherjee, one of the leading lights in the area of maritime law and policy. It presents a mix of background information and insightful analysis by leading experts on a wide range of some of the most pressing and contemporary maritime law and policy topics -- ranging from the development of maritime standards (Mbiah) to the challenges of operating flags of convenience (Mensah), from the latest convention on the international carriage of goods by sea (Basu Bal) to liability and compensation issues related to ship-source marine pollution (Jacobsson, Xu, Kojima), from the intricacies of marine insurance law (Thomas, Gauci) to the vagaries of the conflict of laws (Manolis), and from the legal framework for maritime piracy (Menefee) to the linkages between political stability, economic development, and piracy (Mejia).

This book was released on 2001 with total page 614 pages. Available in PDF, EPUB and Kindle. Book excerpt: Between State and Market surveys and critiques the existing literature on charities law as well as the laws themselves. The authors offer policy prescriptions for the future of an increasingly vital sector of Canadian society. The first section of the book contains an overview of the charitable sector in Canada, a sociological review of altruism in different societies, a discussion of altruism in various philosophical and religious traditions, an economic analysis of "rational voluntarism," and an assessment of the relationship between the charitable sector and the welfare state. The second section contains five papers on the legal definition of charity, both general (the jurisprudence of the Federal Court of Appeal and a proposal for rethinking the concept of "public benefit"), and particular (the political purposes doctrine, religion as charity, and a commentary on the recent major Supreme Court decision on the meaning of charity). The third section deals with the tax status of charities: two papers evaluate the current tax credit system and one deals with the administration of charities by the Canada Customs and Revenue Agency. The final section contains essays on charities and commercial enterprise, on the regulation of fund-raising, and on needed reforms in non-profit corporation law. At a time when the federal government is about to embark on a wide range of policy initiatives to assist and regulate the non-profit sector, these essays are necessary reading for anyone concerned with the future of the charitable sector in Canada. Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays on the rule of law focuses on the traditional question whether the rule of law is necessarily the rule of moral principles, the question of the legitimacy of law. Essays by lawyers, philosophers, and political theorists illuminate and take forward both that question and debate about issues to do with the reach of the rule of law which complicate its answer. The essays are divided into sections which deal, first, with legal orders where the rule of law is under severe stress, second, with the question of the value of the rule of law as a conceptual problem, and, third, with the question of the limits of legal order. Contributors: Richard Abel, Jody Freeman, Robert Alexy, Neil MacCormick, Kenneth Winston, Andras Sajo, Alon Harel, Anton Fagan, Anthony Sebok, Christine Sypnowich, Allan Hutchinson, Bill Scheuerman, John MacCormick, Julian Rivers, Henry Richardson, David Dyzenhaus.
