Book excerpt: Ricks was indicted for buying cotton from a slave without the slave's owner's permission. The owner's son, William L Walthour, suspected that he had been buying cotton and sent a slave to Ricks's house with some cotton to test his suspicions. Ricks bought the cotton and paid the slave in liquor and tobacco. Ricks's counsel argued that if Walthour had instructed the slave to try to sell Ricks the cotton in order to trap him then he should be acquitted. The court found Ricks guilty on the grounds that, regardless of the circumstance, the slaves had not presented written permission to sell. He appealed; the Supreme Court affirmed the verdict.

Four cases were consolidated together in a dispute concerning the distribution of proceeds, following the sale of three steamboats, the John A Moore, the Columbia and the Talomico, which had been navigating the Savannah river. The Bank of Augusta had foreclosed on its mortgage and claimed priority in getting payment over and above other creditors. The sheriff of Richmond county had in his hands a sum of money raised from the sale of three steamboats (the John A Moore, the Columbia and the Talomico), which was claimed by various parties under writs of fieri facias and the Steamboat Lien Laws. This case was heard together with the cases of Daniel Kirkpatrick et al v Bank of Augusta et al (manuscript case A-03350), Joseph M Newby v James Hope et al (manuscript case A-03351) and James Hope et al v Samuel Moore and Thomas N Philpot (manuscript case A-03352). All the parties submitted certain questions of law to the court, which on the evidence made nineteen decisions, all of which were excepted to by one or other of the parties. The Supreme Court held that there was no lien which extended to the hire of slaves on these steamboats, that the foreclosure of the mortgage involved no defects or irregularities, and that the claims of White and Gooodrich for construction work on the John A Moore were properly excluded. The mortgage lien had to be protected. The creditors whose claims were judged to be valid could claim against the proceeds of the sale of the John A Moore.

Book excerpt: Fanny Williams, a free woman of colour and resident of Savannah, died there in 1843. Since 1825 she had owned and dwelt on a plot of land in the city. At her death she left two children, Susan, the ward of the plaintiff, and William. At Fanny's death it appeared the two children shared the plot equally. William Williams died in 1850; he had no children but lived with a woman, Margaret Williams, now the ward of the defendant, recognized by the said William Williams as his wife. After his death Susan remained on her half of the land and Margaret on the other half. The special verdict of the jury was that if Susan was entitled to the plot occupied by Margaret on the basis of her, Susan's, descent from Fanny, then she was to be awarded it with costs, and if, conversely, Margaret was entitled to that half of the plot on the basis of her rights as William's widow, then she was to be awarded it with costs. The court noted that by an act of 1819 all property held by free persons of colour passed to their descendants at their death; it ruled, however, that though neither Margaret nor Susan were descendants of William in the usual sense of descendants meaning children, the legislature intended a broader meaning to be placed on the term (namely, that merely of heirs) and that therefore the half of the plot occupied by Margaret went to her since a wife had more claim on a dead man's property than a sister. The guardian of Susan Ranghill (n?e Williams) excepted to this verdict on six counts, including that that Margaret had not been William's wife because free people of colour could not contract legal marriages. The Supreme Court held that the plaintiff was not entitled to recover even if the law did not recognise the relation of marriage between free persons of colour, there being no special statute in existence that did so; because, if a special statute was necessary for such a recognition, then the relation of brother and sister did not legally exist among free persons of colour either, since there was equally no special statute recognising that. In either event, therefore, the plot in dispute passed to Margaret; judgment affirmed.

Book excerpt: Raymond Demure's will called for the emancipation of some of his slaves and a finacial provision to be made for them. The slaves were manumitted, but the executors failed to pay the annunities and legacies to the freed slaves. These were given instead to the residuary legatees. Two of the slaves died, but the other two, John and Rose, with the help of Alexander Mitchell, filed a bill against the executors. A decree in favour of the complainants was obtained in 1845. The grandsons thereupon paid half of the sum owing. A levy was then made upon 13 slaves to obtain the other half, but Alexander Scranton and Edwin M Moore intervened as trustees with a claim to these slaves. Scranton and Moore got a verdict in favour of their claim in 1847. Before an appeal on this was heard at the Glynn Superior Court, one of the freed slaves, Rose, died. The Supreme Court decided that the suit should have been abated on the death of Rose and that administration needed to be taken out on her estate. The judgment in the court below in favour of John and Rose on this issue was reversed. Their claim had to be settled by claiming first upon funds still in the hands of the executors and it was held that there was no deficiency of such assets.

Book excerpt: The petitioners were free persons of colour and the rights of free persons of colour were disputed in this case. They were not citizens according to the constitution and laws of the State of Georgia. A charge of [dollars] 100 was levied against any free persons of colour living in the city of Savannah. Those who could not pay were imprisoned. In this case it was argued that the charge was a tax and had to be collected in the same way as other taxes and that a person could not be imprisoned for not paying a local tax. The judgment of the Supreme Court was that the levy was actually a tax. It held that the city ordinance was unlawful and void. Non-payers could not be imprisoned, but should have been hired out instead to collect the sum owing. Therefore the judgment of the lower court was reversed.

Book excerpt: The bill was instituted by Ingram to compel Mitchell to account to him for the sale of a slave, Simon, whom he had placed in Mitchell's hands to sell. In 1856 Simon had been indicted for attempting to rape a white woman. Ingram, standing as security for Simon's appearance in court, entered into the agreement with Mitchell to sell Simon, under which if he sold him he should account to Ingram for [dollars] 1,200, and if he failed to sell him he should return him. Ingram's apparent motive for selling Simon was to sell his life, which was endangered by the charge against him. Mitchell executed notes for [dollars] 1,200 to Ingram on the assumption that he would sell, which he succeeded in doing. Mitchell prayed that the agreement made to screen Simon from trial was illegal and so could not be enforced against him for the payment of his note. The court found for Mitchell and Ingram appealed. The Supreme Court reversed the verdict, finding that Simon had been acquitted before he was sold, the woman herself and every body else being satisfied of his innocence, and that he was immediately repurchased by Ingram, with whom he had remained since. Justice Lumpkin observed that prompted by humanity, and from no mercenary motives, masters are sometimes induced to put their slaves out of the way to prevent them from becoming the victims of popular excitement, until the tempest of passion is past and reason has resumed her sway.
