Available in PDF, EPUB and Kindle. Book excerpt: In this definitive study, Lawrence J. LeBlanc examines the nearly forty-year struggle over ratification of the Genocide Convention by the United States. LeBlanc's analysis of the history of the convention and the issues and problems surrounding its ratification sheds important light on the process of treaty ratification in the United States and on the role of American public opinion and political culture in international human rights legislation. Drawing on case studies of genocide committed since World War II, the author also confronts the strengths and weaknesses of international adjudication as a whole. Adopted by the United Nations General Assembly in 1948 in response to the atrocities committed by the Nazis before and during World War II, the Genocide Convention was finally made law by the United States Senate in 1988 contingent upon a series of "conditions"--known as the "Lugar-Helms-Hatch Sovereignty Package"--which, LeBlanc suggests, markedly weakened the convention. Through careful analysis of the bitter debates over ratification, LeBlanc demonstrates that much of the opposition to the convention sprang from fears that it would be used domestically as a tool by groups such as blacks and Native Americans who might hold the U.S. accountable for genocide in matters of race relations.

Available in PDF, EPUB and Kindle. Book excerpt: Even though the Constitution proclaims treaties entered into by the United States to be part of the supreme law of the land and authorises prosecution of offences against the law of nation in federal courts, the United States has had a checkered record in ratifying human rights instruments, in upholding decisions of international tribunals, and indeed in submitting itself to the jurisdiction of such tribunals. It refused to uphold judgments of the International Court of Justice within its municipal legal system, terminated the competence of the ICJ to adjudicate international disputes to which it is a party, and attempted to undermine the functioning of the international criminal court. It engaged in armed conflicts in blatant violation of international humanitarian law and subjected belligerent detainees to unbecoming interrogation techniques. There are clear indications that the Obama administration is setting the United States on a new course of international comity and Völkerrechtsfreundlichkeit.

Book excerpt: This massive, four-volume work provides students with a close examination of 10 modern genocides enhanced by documents and introductions that provide additional historical and contemporary context for learning about and understanding these tragic events. Modern Genocide: The Definitive Resource and Document Collection spans nearly 1,700 pages presented in four volumes and includes more than 120 primary source documents, making it ideal for high school and beginning college students studying modern genocide as part of a larger world history curriculum. The coverage for each modern genocide, from Herero to Darfur, begins with an introductory essay that helps students conceptualize the conflict within an international context and enables them to better understand the complex role genocide has played in the modern world. There are hundreds of entries on atrocities, organizations, individuals, and other aspects of genocide, each written to serve as a springboard to meaningful discussion and further research. The coverage of each genocide includes an introductory overview, an explanation of the causes, consequences, perpetrators, victims, and bystanders; the international reaction; a timeline of events; an Analyze section that poses tough questions for readers to consider and provides scholarly, pro-and-con responses to these historical conundrums; and reference entries. This integrated examination of genocides occurring in the modern era not only presents an unprecedented research tool on the subject but also challenges the readers to go back and examine other events historically and, consequently, consider important questions about human society in the present and the future.

Book excerpt: This book documents the devastating effects of genocide in the world's most destructive human environments since the end of World War II and explores why such events still occur. A Biographical Encyclopedia of Contemporary Genocide: Portraits of Evil and Good is a unique study of humanity's most reprehensible actions. It documents genocides that have occurred after World War II—a period that was supposed to be the fulfillment of the promise "never again"—by providing biographies rather than extensive historical narratives. The entries describe the personal backgrounds; careers; and relationship to genocidal events, humanitarian actions, or international initiatives relevant to each person in the book. Beyond examining the genocidaires who played key roles in mass murder, individuals who contributed to efforts to stop genocide are also profiled. By adopting a biographical approach to post-World War II genocide, the author sheds light on why people behave the way they do toward their fellow human beings and provides vital insights into the extremes of human positivity and negativity that have characterized this period of history. Serving as a vital tool for scholars and students of genocide as well as compelling reading for general audiences, the book highlights individual human behaviors, motivations, backgrounds, and intentions that can form a platform from which to raise and discuss issues of morality and ethics in the modern world.

Book excerpt: For over forty years, Cold War concerns about the threat of communism shaped the contours of refugee and asylum policy in the United States, and the majority of those admitted as refugees came from communist countries. In the post-Cold War period, a wider range of geopolitical and domestic interests influence which populations policymakers prioritize for admission. The Refugee Challenge in Post-Cold War America examines the actors and interests that have shaped refugee and asylum policy since 1989. Policymakers are now considering a wider range of populations as potentially eligible for protection: victims of civil unrest, genocide, trafficking, environmental upheaval, and gender-based discrimination, among others. Many of those granted protected status since 1989 would never have been considered for admission during the Cold War. Among the challenges of the post-Cold War era are the growing number of asylum seekers who have petitioned for protection at a port of entry and are backlogging the immigration courts. Concerns over national security have also resulted in deterrence policies that have raised important questions about the rights of refugees and the duties of nations. María Cristina García evaluates the challenges of reconciling international humanitarian obligations with domestic concerns for national security.

Book excerpt: What could be more American than Columbus Day? Or the Washington Redskins? For Native Americans, they are bitter reminders that they live in a world where their identity is still fodder for white society. "The law has always been used as toilet paper by the status quo where American Indians are concerned," writes Ward Churchill in Acts of Rebellion, a collection of his most important writings from the past twenty years. Vocal and incisive, Churchill stands at the forefront of American Indian concerns, from land issues to the American Indian Movement, from government repression to the history of genocide. Churchill, one of the most respected writers on Native American issues, lends a strong and radical voice to the American Indian cause. Acts ofRebellion shows how the most basic civil rights' laws put into place to aid all Americans failed miserably, and continue to fail, when put into practice for our indigenous brothers and sisters. Seeking to convey what has been done to Native North America, Churchill skillfully dissects Native Americans' struggles for property and freedom, their resistance and repression, cultural issues, and radical Indian ideologies.
