Book excerpt: TAMS/BERSTER/SCHIFFBAUER “The 1948 Convention on the Prevention and Punishment of the Crime of Genocide is the first universal human rights treaty of the United Nations era, the cornerstone of the international legal regime against the crime of genocide and a key influence on developments in many other areas of international law. In this article-by-article commentary each of the Genocide Convention’s 19 provisions is are analysed comprehensively. Drawing on case-law of the International Court of Justice, international criminal courts and tribunals, regional human rights courts and national, as well as domestic jurisprudence of many States, this commentary provides authoritative guidance on the Genocide Convention, including key matters such as the definition of genocide, the duty of States to prevent and punish it, and on the Convention’s implementation regime.”

Book excerpt: The 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention) has a special standing in international law and international politics. For 60 years, the crime of genocide has been recognised as the most horrendous crime in international law, famously designated the 'crime of crimes'. On the occasion of the 60th anniversary of its adoption the UN High Commissioner for Human Rights stated that 'genocide is the ultimate form of discrimination'. In the same context the chief prosecutor of the International Criminal Court described the Genocide Convention as a 'visionary and founding text for the Court'. The Convention has as such influenced the subsequent development of many different areas of international law. For example, the 1951 Advisory Opinion on the Genocide Convention enabled the International Court of Justice to shape the modern regime of reservations to treaties. More recently, the prohibition against genocide has become a crucial pillar of the regime of international criminal law developing since the 1990s, with genocide being one of the core crimes falling under the jurisdiction of the UN ad hoc tribunals, the Extraordinary Chambers in the Courts of Cambodia and the permanent International Criminal Court. In this work the 19 provisions of the Convention are analysed article-by-article, with abundant references to state practice and case law.
Book Synopsis The Genocide Convention Sixty Years after its Adoption by : Christoph J. M. Safferling
Download or read book The Genocide Convention Sixty Years after its Adoption written by Christoph J. M. Safferling and published by T.M.C. Asser Press. This book was released on 2011-07-13 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1948 the Convention on the Prevention and Punishment of the Crime of Genocide was adopted by the General Assembly of the United Nations. Thereby genocide was defined as an international crime. Sixty years after its adoption, the prosecution of the crime of genocide still raises multiple questions. Although genocide was not a crime during the Nuremberg Trial its historic roots rest with the persecution of Jews and other minorities by Nazi-Germany. Because of this historic focus the legal definition of genocide is difficult to apply to other conflicts. Bringing together scholars and practitioners, this volume of essays examines the Genocide Convention from historic, legal and social science perspectives. Contemporary witnesses also report on their experiences of the Nuremberg, the Eichmann and the Auschwitz trials.

Book Synopsis Implementation of International Law in the United States by : Johan D. Van der Vyver
Download or read book Implementation of International Law in the United States written by Johan D. Van der Vyver and published by Peter Lang. This book was released on 2010 with total page 316 pages. Available in PDF, EPUB and Kindle. Book excerpt: Even though the Constitution proclaims treaties entered into by the United States to be part of the supreme law of the land and authorises prosecution of offences against the law of nation in federal courts, the United States has had a checkered record in ratifying human rights instruments, in upholding decisions of international tribunals, and indeed in submitting itself to the jurisdiction of such tribunals. It refused to uphold judgments of the International Court of Justice within its municipal legal system, terminated the competence of the ICJ to adjudicate international disputes to which it is a party, and attempted to undermine the functioning of the international criminal court. It engaged in armed conflicts in blatant violation of international humanitarian law and subjected belligerent detainees to unbecoming interrogation techniques. There are clear indications that the Obama administration is setting the United States on a new course of international comity and Völkerrechtsfreundlichkeit.
