On the one hand, Americans don't want "big government" meddling in their lives; on the other hand, they have repeatedly enlisted governmental help to impose their views regarding marriage, abortion, religion, and schooling on their neighbors. These contradictory stances on the role of public power have paralyzed policymaking and generated rancorous disputes about government’s legitimate scope. How did we reach this political impasse? Historian Gary Gerstle, looking at two hundred years of U.S. history, argues that the roots of the current crisis lie in two contrasting theories of power that the Framers inscribed in the Constitution. One theory shaped the federal government, setting limits on its power in order to protect personal liberty. Another theory molded the states, authorizing them to go to extraordinary lengths, even to the point of violating individual rights, to advance the "good and welfare of the commonwealth." The Framers believed these theories could coexist comfortably, but conflict between the two has largely defined American history. Gerstle shows how national political leaders improvised brilliantly to stretch the power of the federal government beyond where it was meant to go—but at the cost of giving private interests and state governments too much sway over public policy. The states could be innovative, too. More impressive was their staying power. Only in the 1960s did the federal government, impelled by the Cold War and civil rights movement, definitively assert its primacy. But as the power of the central state expanded, its constitutional authority did not keep pace. Conservatives rebelled, making the battle over government’s proper dominion the defining issue of our time. Highlighting the gap between reports of coerced sex and incidents that were publicly classified as rape, Block demonstrates that public definitions of rape were based less on what actually happened than on who was involved. She challenges conventional narratives that claim sexual relations between white women and black men became racially charged only in the late nineteenth century. Her analysis extends racial ties to rape back into the colonial period and beyond the boundaries of the southern slave-labor system. Book excerpt: Gender-based violence has a direct impact on a range of women's reproductive health problems, including adolescent pregnancy, high-risk sexual behavior, sexually transmitted diseases, neonatal and maternal mortality, and chronic pelvic pain. To facilitate integration of these two areas, the Population Council's Ebert Program on Critical Issues in Reproductive Health and the Health and Development Policy Project met together in November 1993. It has been demonstrated that women who have been sexually abused as children are at increased risk of early initiation of intercourse, multiple partners, unprotected sex, prostitution, drug and alcohol abuse, depression, and low self-esteem. Although most societies condemn incest and forced intercourse with an unmarried virgin, coerced sex within marriage or with a sexually experienced woman may be tolerated. The general paucity of research on coerced sex reflects the more general avoidance of issues of gender and power. Seminar participants identified six priority areas for research: sociocultural contexts that shape and support sexual coercion; the integration of questions on sexual violence into ongoing research on AIDS, sexuality, and reproductive health in order to gain prevalence data; the cultural meanings attached to sexual trauma; the physical and psychological consequences of sexual coercion; processes within the criminal justice, legal, media, and medical care systems that perpetuate sexual victimization; and effective interventions.

Finding it difficult to fight these opponents directly, many governments instead target states that harbor or aid nonstate actors, using threats and punishment to coerce host states into stopping those groups. Wendy Pearlman and Boaz Atzili investigate this strategy, which they term triadic coercion. They explain why states pursue triadic coercion, evaluate the conditions under which it succeeds, and demonstrate their arguments across seventy years of Israeli history. This rich analysis of the Arab-Israeli conflict, supplemented with insights from India and Turkey, yields surprising findings. Traditional discussions of interstate conflict assume that the greater a state’s power compared to its opponent, the more successful its coercion. Turning that logic on its head, Pearlman and Atzili show that this strategy can be more effective against a strong host state than a weak one because host regimes need internal cohesion and institutional capacity to move against nonstate actors. If triadic coercion is thus likely to fail against weak regimes, why do states nevertheless employ it against them? Pearlman and Atzili’s investigation of Israeli decision-making points to the role of strategic culture. A state’s system of beliefs, values, and institutionalized practices can encourage coercion as a necessary response, even when that policy is prone to backfire. A significant contribution to scholarship on deterrence, asymmetric conflict, and strategic culture, Triadic Coercion illuminates an evolving feature of the international security landscape and interrogates assumptions that distort strategic thinking.

Professor Steinfeld argues that wage workers were not employees at will but were often bound to their employment by enforceable labor agreements, which employers used whenever available to manage their labor costs and supply. In the northern United States, where employers normally could not use penal sanctions, the common law made other contract remedies available, also placing employers in a position to enforce labor agreements. Modern free wage labor only came into being late in the nineteenth century, as a result of reform legislation that restricted the contract remedies employers could legally use.

Book excerpt: In this book, Rhodes provides a nonevaluative account of coercion. He begins with a thorough discussion of the charge that coercion is an essentially contested concept. He argues that effective communication of regulations pertaining to human conduct requires a basic level of clarity as to the kind of conduct being regulated. Accordingly, he argues that before we prescribe or proscribe conduct, we should describe it. In short, he maintains that wherever possible description should precede prescription and proscription. Rhodes begins his descriptive project by providing a fundamental account of human motivation. Upon this foundation he supports his distinctions between threats, offers, throffers, and neutral proposals. He argues that all coercion claims can be understood in light of these components. He applies this analysis to three prominent accounts of coercion as advanced by F.A. Hayek, Harry Frankfurt, and Robert Nozick. After comparing and contrasting these views, Rhodes provides his own account. Rhodes's account is based upon the identification of what he refers to as perceived-threat-avoidance-behavior as a necessary condition for coercion. As a descriptive, or nonevaluative, account, Rhodes is able to identify coercion independent from normative judgments. He argues that it is not the wrongfulness of some conduct that makes it coercion, instead, it is the coerciveness of some conduct that makes it wrong. Unique to Rhodes's account, coercion is not necessarily wrong. As a descriptive account, his view permits an independent analysis of the moral status of an act of coercion. The book concludes with a discussion of the normatively significant variables of a coercion claim.
