Dimitris Vardoulakis argues that Kafka constructs these plots of confinement in order to laugh at his heroes’ futile attempts to express their will. In this way, Kafka emerges as a critic of the free will and as a proponent of a different kind of freedom: one focused within the confines of one’s experience and mediated by one’s circumstances. Vardoulakis contends that his sense of humor is the key to understanding Kafka as a political thinker. Laughter, in this account, is the tool used to deconstruct power. Book excerpt: In The Penal Colony by Franz Kafka ("In der Strafkolonie") (also translated as "In the Penal Settlement") is a short story by Franz Kafka written in German in October 1914, revised in November 1918, and first published in October 1919. As in some of Kafka's other writings, the narrator in this story seems detached from, or perhaps numbed by, events that one would normally expect to be registered with horror. Internal clues and the setting on an island suggest Octave Mirbeau's The Torture Garden as an influence. Synopsis: The story focuses on the Traveler, who has just arrived in an island penal colony and is encountering its brutal execution machine for the first time. Everything about the functioning of the intricate machine and its purpose and history is told to him by the Officer. The Soldier and the Condemned, who is unaware that he has been sentenced to die for failing to get up and salute his superior's door each hour during his night watch, placidly watch from nearby. Under the judicial process associated with the machine, the accused is always assumed to be guilty and is not given a chance to defend himself. As punishment, the law the man has broken is inscribed progressively deeper on his body over a period of 12 hours as he slowly dies from his wounds. During their final six hours in the machine, the accused become still and appear to experience a religious epiphany. The machine was designed by the colony's previous Commandant, of whom the Officer is a devoted supporter. He carries its blueprints with him and is the only person who can decipher them, not allowing anyone else to handle them. Eventually, it becomes clear that the machine has fallen out of favor since the death of the previous Commandant and the appointment of a successor. The Officer is nostalgic regarding the torture device and the values that were initially associated with it, recalling the crowds that used to attend each execution. Now, he is the last outspoken proponent of the machine, but he strongly believes in its form of justice and the infallibility of the previous Commandant.

If Kafka’s writings may be seen to belong to Jewish national culture and if they may be considered part of Israel’s heritage, then their analysis within a Jewish framework should be both viable and valuable. This volume is dedicated to the research of Franz Kafka’s late narrative “The Burrow” and its autobiographical and theological significance. Research is extended to incorporate many fields of study (architecture, sound studies, philosophy, cultural studies, Jewish studies, literary studies) to illustrate the dynamics at work within the text which reveal the Jewish aspects implicitly thematicized. Examination of the structure created, the nature of sound perceived, the atmosphere experienced and the acts performed by the protagonist serve as the foundation of this analysis and offer new access to Kafka’s work by presenting an interpretive, space-semantic approach. “Der Bau” is presented as a life concept given the task of constituting identity, highlighting the critical link between the literary and biographical Kafka and demonstrating the necessity of understanding the author as a Jewish writer to understand his late narrative. For her outstanding research project, Andrea Newsom Ebarb was awarded the “Forschungsförderpreis der Vereinigung der Freunde der Universität Mainz e.V.” in 2023.

This provocative book examines this insufficiently understood form of warfare in post-genocide Rwanda, where it contributed to the making of dictatorship. Jens Meierhenrich provides a redescription of Rwanda's daring experiment in transitional justice known as inkiko gacaca. By dissecting the temporally and structurally embedded mechanisms and processes by which change agents in post-genocide Rwanda manoeuvred to create modified legal arrangements of things past, Meierhenrich reveals an unexpected jurisprudence of violence. Combining nomothetic and ideographic reasoning, he shows that the deformation of the gacaca courts – and thus the rise of lawfare in post-genocide Rwanda – was not preordained but the outcome of a violently structured contingency. The Violence of Law tells a disturbing tale and will appeal to scholars, advanced students, and practitioners of international and comparative law, African studies and human rights.
