Diese werden meist durch Drittparteien geregelt, die den Konfliktparteien unterstützend zur Seite stehen und darauf bedacht sind, weitere Eskalationen zu unterbinden und den sogenannten peacebuilding-Prozess voranzutreiben. Dazu stehen diesen von den in Konflikt stehenden Parteien unabhängige dritte Parteien je nach Konfliktphase unterschiedliche Interventionsmöglichkeiten zur Verfügung. In dieser Arbeit soll zunächst geklärt werden, wie sich der Begriff "Konflikt" definiert und wodurch Konflikte zwischen zwei oder mehr Parteien entstehen und welche Folgen diese für beide Seiten nach sich ziehen können. Anschließend wird auf die Typologie der Präventionsmaßnahmen weiterer Eskalationen von Konflikten eingegangen, wobei Konflikte nach unterschiedlichen Merkmalen in spezielle Kategorien differenziert werden und dementsprechend von Drittparteien und deren Interventionsmaßnahmen angesprochen werden können. Konfliktmanagement, Konfliktlösung und Konflikttransformation sind hier die zentralen zu betrachtenden Ansätze. Dazu werden letztlich Lösungsansätze zur Deeskalationen oder gar Beseitigung von Konflikten entweder durch die Konfliktparteien selbst oder durch die angesprochenen Drittparteien aufgezeigt sowie deutlich gemacht, wann welcher Ansatz am besten geeignet ist, um Konflikte beizulegen.

Die vorliegenden Einführungen basieren auf einem konflikttheoretischen Ansatz. Konflikte werden verstanden als ubiquitäre soziale Erscheinungen, die erst einmal weder gut noch schlecht sind. Konflikte beruhen auf Unter schieden in den sozialen Lagen der Menschen und/oder auf Unterschieden in den Interessenkonstellationen. Ein Problem dieses Ansatzes besteht in der Breite des Gegenstandsbereichs, der bewaffnete Auseinandersetzungen zwi schen Staaten und Staatenbündnissen ebenso beinhaltet wie soziale, ökono mische und politische -Konfliktlagen regionaler oder globaler Art. Bearbeitet wird diese Schwierigkeit durch die Entwicklung einer Konfliktsystematik, die dem Untersuchungsfeld eine Struktur gibt. Der Bezugspunkt der Frie densforschung im engeren Sinne, nämlich organisierte militärische Gewalt zwischen politischen Einheiten, bildet einen sehr wichtigen Gegenstand der Betrachtung, aber eben nur einen unter mehreren. In diesem Sinne beabsich tigen wir eine Einführung in die Friedens-und Konfliktforschung. Bei einem Verständnis von Friedensforschung im engeren Sinne sind die Probleme der Gegenstandsabgrenzung allerdings kaum geringer. Besteht Frieden vor allem in der Garantie der Existenzerhaltung und Existenz entfaltung, dann muß sich Existenzentfaltung überwiegend auf soziale und ökonomische Lebensbedingungen beziehen, die beim eigenen Ansatz von vornherein im Konfliktbegriff enthalten sind.

Es gibt keine allgemeingültige Definition des Wortes „Konflikt“! Dieses Wort stammt ursprünglich von dem lateinischen Terminus „conflictus“ und bedeutet Streit, Zwiespalt oder Zusammenprallen. Sobald mehrere Personen an einer Entscheidung beteiligt sind und diese gegensätzliche Meinungen oder Interessen haben kann ein sozialer Konflikt entstehen. Neben den sozialen Konflikten gibt es auch noch die seelischen (intrapersonellen) Konflikte. Das sind Konflikte, die man mit sich selbst hat (z.B. soll ich das Kleid heute anziehen oder lieber doch nicht). In dieser Belegarbeit werden wir uns aber hauptsächlich auf die sozialen Konflikte konzentrieren.

While the archaic desire for revenge persisted into the classical period, it was channeled by the civil discourse of the democracy. Forensic speeches, curse tablets, and comedy display a remarkable openness regarding the definition of violence. But in daily life, Athenians had to draw the line between acceptable and unacceptable behavior. They did so by enacting a discourse on violence in the performance of these genres, during which complex negotiations about the legitimacy of violence took place. Performances such as the staging of trials and comedies ritually defined the meaning of violence and its appropriate application. Speeches and curse tablets not only spoke about violence, but also exacted it in a mediated form, deriving its legitimate use from a democratic principle, the communal decision of the human jurors in the first case and the underworld gods in the second. Since discourse and reality were intertwined and the discourse was ritualized, actual violence might also have been partly ritualized. By still respecting the on-going desire to harm one’s enemy, this partial ritualization of violence helped restrain violence and thus contributed to Athens’ relative stability.

Jurists and laypersons always ask for the precise meaning of a certain piece of the law. In linguistics, the discipline investigating 'meaning' is semantics; thus, it is to be expected that semantics can contribute to a correct understanding of the law. Chapter 1 also investigates the alleged incomprehensibility of legal language with the help of psycholinguistics. Chapter 2 is on identifying the criminal. To find the author of a blackmailer's letter, text/ corpus linguistics is instrumental. If the blackmailer uses the telephone instead of the letter, speaker identification and phonetics are necessary. The BKA stores all blackmailing letters in a database, but databases are only one possibility of organizing legal systems; another possibility is the application of tools from computational linguistics and artificial intelligence. These tools can be useful to handle terminology, to retrieve information, or to model legal theorizing in a formal system. Chapter 3 demonstrates a variety of examples of organizing legal systems. The topic of chapter 4 is multilingualism and the law. The European legislation is a product of legal and linguistic diversity, as the member states do not only differ in languages but also in their legal systems. One paper shows how Switzerland handles its multilingualism in legal drafting. The input of translation studies is of course vital in this field of research. An index for both subjects and persons complements the volume.
