Book excerpt: Excerpt from Foreign Rights and Interests in China The purpose of this volume is to provide a statement of the rights of foreigners and the interests of foreign States in China as they are to be found stated in treaties with or relating to China or in other documents of an official or quasi-official character. Viewed from the other side, the account will exhibit the limitations under which the Chinese Government is compelled to act not only with regard to matters of international obligation but as to matters which, in countries more fortunately circumstanced, are of purely domestic concern. Whether the purpose of the volume has been satisfactorily achieved, the reader will determine, but that there is a pressing need for a work that will furnish an explanation and definite statement of the rights and interests which the Treaty Powers and their nationals have obtained in China, few will question. Anyone who has been in China, or has had business interests with that country, or has sought to gain an understanding of the conflict of national interests in the Far East, will testify to the urgency of this need. This is not to say, however, that there are not already books which deal with many of these topics. There are such treatises, and among them, especially deserving mention, aTe: H. B. Morse's The Trade and Administration of China, 2d ed., published in 1913, and his three volumes on Foreign Relations of the Chinese Empire, 1884-1911; V. K. Wellington Koo's The Status of Aliens in China, published in 1912; T. R. Jemigan's China in Law and Commerce, published in 1905; T. W. Overlach's Foreign Financial Control in China, published in 1919; and M. T. Z. Tyau's The Legal Obligations Arising out of Treaty Relations between China and Other States, published in 1917. From these volumes the author has derived the greatest aid. It will appear, however, that he has explained many matters Which are not discussed by these earlier writers, and, of course, there has been opportunity to deal with the important developments of the last few years. In particular, it shows how the management of non-traditional security issues abroad led to the emergence of China's strategy to defend its interests overseas. This book comes at a critical time, as China has just inaugurated its first overseas military base in Djibouti, thereby establishing a long-term military presence outside Asia. Based on a large number of Chinese primary sources, the book examines how the main actors involved in the making and implementation of Chinese foreign policy understood the problem of protecting the assets and lives of Chinese companies and nationals abroad, especially in North Africa and the Middle East, and interacted with each other depending on their priorities, preferences, and organizational interests. As the different chapters explore various aspects and dynamics within the Chinese foreign and security policy machine, the analysis concludes that the emergence of China's strategy to defend its interests overseas was, to a large extent, crisis-driven. The evacuation of 36,000 Chinese nationals from Libya in 2011 was a critical moment in this process. Henceforth, significant efforts were made to strengthen the capabilities of and coordination between the different agencies under the control of the Chinese leadership, especially the Chinese People's Liberation Army. Consistently, China's military presence abroad expanded and evolved over the years to stabilize the regions where the country's human and economic presence is most significant, and to neutralize the non-traditional security threats against it. However, Chinese policymakers still face important challenges and complex dilemmas on the path to formulate a sustainable policy towards this very difficult issue. Protecting China's Interests Overseas also offers an opportunity to rethink how we study and understand Chinese foreign policymaking.

At stake, however, are much more than moral concerns and hurt national feelings. To Washington, the undemocratic nature of the Chinese government makes it ultimately suspect on all issues. To Beijing, the human rights pressure exerted by the West on China seems designed to compromise its legitimacy. As China's economic power grows and its influence on the politics of developing countries continues, an understanding of the place of human rights in China's foreign relations is crucial to the implementation of an effective international human rights agenda. In Human Rights in Chinese Foreign Relations, Ming Wan examines China's relations with the United States, Western Europe, Japan, and the United Nations human rights institutions. Wan shows that, after a decade of persistent external pressure to reform its practices, China still plays human rights diplomacy as traditional power politics and deflects pressure by mobilizing its propaganda machine to neutralize Western criticism, by making compromises that do not threaten core interests, and by offering commercial incentives to important nations to help prevent a unified Western front. Furthermore, at the UN, China has largely succeeded in rallying developing nation members to defeat Western efforts at censure. In turn, it is apparent to Wan that, while the idea of human rights matters in Western policy, it has seldom prevailed over economic considerations or concerns about national security. Western governments have not committed as many policy resources to pressuring Beijing on human rights as to other issues, and the differing degrees of commitment to human rights-related foreign policy explain why Japan, Western Europe, and the United States, in that order, have gradually retreated from confronting China on human rights issues.
