It is an attempt to identify, as far as possible, what occurs in and between countries when foreign investments are made in mineral development, concentrating on two main themes: on the nature of the transactions which constitute the process of foreign investment on the physical level – money and instruments of credit, objects, information and people as they cross national boundaries – and on the nature of the relationships which are created between foreign investors and governments in the countries where the investments are made. The author argues that the nature of physical transactions plays a crucial role in determining the character of host country-foreign investor relations, and the policies and attitudes adopted by host country authorities exercise an important influence, in turn, on the physical effects of foreign investments. As such, the book constitutes a comprehensive overview of the economic and political factors involved in mining and its development.

Book excerpt: Foreign direct investment in the natural resource industries is fostered through the signing of concession agreements between the host State and the investor. However, such concessions are susceptible to alteration by the host State, meaning that many investors now require the insertion of stabilization clauses. These are provisions that require the host State to agree that they will not take any administrative or legislative action that would adversely affect the rights of the investor. Arguing that it is necessary to have some form of flexibility in concession agreements while still offering protection of the legitimate expectations of the investor, Resource Nationalism in International Investment Law proposes the insertion of renegotiation clauses in order to foster flexible relationships between the investor and the host State. Such clauses bind the parties to renegotiate the terms of the contract, in good faith, when prevailing circumstances change. However these clauses can also prove problematic for both State and investor due to their rigidity. Using Zambia as a case study, it highlights the limitations of the efficient breach theory to emphasise the need for contractual flexibility.

While many mechanisms may be at work, investment seems to play a major role. In a copper price boom, the higher copper price and associated capital inflows create upward pressure on the real exchange rate. The appreciation of the Chilean peso during the first part of the copper cycle contributes to lower inflation, which could partly explain why real wages grow more rapidly in this part of the cycle.
