Book Synopsis Understanding the Financial Conduct Authority by : Ashley Kovas
Download or read book Understanding the Financial Conduct Authority written by Ashley Kovas and published by Troubador Publishing Ltd. This book was released on 2015-07-28 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Financial Conduct Authority began its work in April 2013 with a post-crisis mandate to take pre-emptive action against firms. When problems occur, the FCA increasingly takes disciplinary action against individual senior managers as well as against the firm. Most of these cases are tragedies – if the individuals concerned understood the likely outcome they would have behaved differently. This book sets out the psychology of the FCA and covers the ‘hot spots’ that senior management and their compliance officers need to get right. The key to the FCA approach is ‘conduct risk’. This deliberately undefined term includes anything that might cause a problem to the FCA in the achievement of its regulatory mission. The FCA sees the world through the lens of risk; everything, including firms themselves, are assessed on how likely they are to cause the FCA to fail in its role of securing appropriate protection for consumers, enhancing the integrity of the UK financial system and promoting effective competition in the interests of consumers. Conduct risk is about behaviour and the FCA is keen to understand the drivers of human behaviour and how they can use them to bring about the outcomes they wish to see. Firms’ culture is also under the microscope, all the more so since the recent trading incidents where groups of traders colluded across firms to manipulate LIBOR and the foreign exchange markets. A chapter on Culture examines how firms can start work to prepare for the FCA’s increasing engagement on culture. The starting point of course is to understand what culture is.
Book Synopsis A new approach to financial regulation by : Great Britain. Treasury
Download or read book A new approach to financial regulation written by Great Britain. Treasury and published by The Stationery Office. This book was released on 2010-07-26 with total page 76 pages. Available in PDF, EPUB and Kindle. Book excerpt: This document outlines the Government's programme of reform to renew the UK's system of financial regulation. It believes that weaknesses were inherent in the tripartite approach whereby three authorities - the Bank of England, the Financial Services Authority and the Treasury - were collectively responsible for financial stability. The Government will create a new Financial Policy Committee (FPC) in the Bank of England with primary statutory duty to maintain financial stability. The FPC will be given control of macro-prudential tools to ensure that systemic risks to financial stability are dealt with. This macro-prudential regulation must be co-ordinated with the prudential regulation of individual firms. Operational responsibility for prudential regulation will transfer from the FSA to a new subsidiary of the Bank of England, the Prudential Regulation Authority. The third development is the creation of a dedicated Consumer Protection and Markets Authority (CPMA) with a primary statutory responsibility to promote confidence in financial services and markets. Protection of consumers will be delivered though a strong consumer division within CPMA. The document also covers: the issue of market regulation; co-ordination of the regulatory bodies in a potential crisis; the next steps, including public consultation, legislative passage and operational implementation. The Government will, after considering responses, produce more detailed proposals - including draft legislation - for further consultation in early 2011, with a view to having legislation on the statute book within two years.

Book Synopsis Culture Audit in Financial Services by : Roger Miles
Download or read book Culture Audit in Financial Services written by Roger Miles and published by Kogan Page Publishers. This book was released on 2021-06-03 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the next wave of conduct regulation in financial markets, from 2021 conduct regulators in the UK and elsewhere expect firms to produce evidence on how they are improving behaviour and culture. Facing this, many practitioners are anxious that their current reporting and management information (MI) are irrelevant to meeting as-yet unclear regulatory expectations. This book provides the insights and tools firms need to report on culture, securing both enhanced business value and the regulator's approval. Culture is now seen as a key contributor to good governance, feeding into existing discourse on environmental, social and governance (ESG) factors and the emerging dialogue on 'non-financial (mis)conduct', but conventional measures of business quality are unfit for the new reporting agenda. Culture Audit in Financial Services follows the arc of 'behavioural regulation' to examine what the regulator really wants, before offering guidance on how culture audit differs from conventional auditing, how to put the latest pure-research findings to work, and the key features of well-designed conduct and culture reports. Written by an impartial author and a variety of contributors with extensive experience working with practitioners, regulators, and many of the world's finest academic initiatives, this book is filled with practical, grounded advice on how best to approach this new challenge and avoid infractions.

In any future crisis it will be clear that the Chancellor of the Exchequer is in charge. Regulation of consumer credit will be brought within the remit of the Financial Conduct Authority.

This book was released on 2019-10-16 with total page 109 pages. Available in PDF, EPUB and Kindle. Book excerpt: The October 2019 Global Financial Stability Report (GFSR) identifies the current key vulnerabilities in the global financial system as the rise in corporate debt burdens, increasing holdings of riskier and more illiquid assets by institutional investors, and growing reliance on external borrowing by emerging and frontier market economies. The report proposes that policymakers mitigate these risks through stricter supervisory and macroprudential oversight of firms, strengthened oversight and disclosure for institutional investors, and the implementation of prudent sovereign debt management practices and frameworks for emerging and frontier market economies.
Book Synopsis New Accountability in Financial Services by : Joe McGrath
Download or read book New Accountability in Financial Services written by Joe McGrath and published by Springer Nature. This book was released on 2022-01-01 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a critical examination of recently introduced individual accountability regimes that apply to the financial services industry in the UK (SMCR) and Australia (BEAR and the forthcoming FAR), together with a forthcoming new individual accountability regime ( in particular, SEAR) in Ireland. It provides a framework for analysing whether these regimes will achieve behavioural change in the financial services industry. This book argues that, whilst sanctioning individuals to deter future misconduct is an important part of any successful regulatory strategy, the focus should be on ensuring that individuals in the financial services industry internalise the norms of behaviour expected under the new regimes. In this regard, the analysis in this book is informed by criminological theory, regulatory theory and behavioural science. The work also argues for a “trajectory towards professionalisation” of financial services, and banking in particular, as an important means of positively influencing industry-wide norms of behaviour, which have a key influence on firms’ and individuals’ behaviours.

Download or read book A new approach to financial regulation written by Great Britain. Treasury and published by The Stationery Office. This book was released on 2011-02-17 with total page 138 pages. Available in PDF, EPUB and Kindle. Book excerpt: This document presents more detailed proposals for financial regulation following on from the consultation paper "A new approach to financial regulation: judgment, focus and stability" (July 2010, Cm. 7874, ISBN 9780101787420) and continuing policy development by the Treasury, Bank of England and Financial Services Authority. The Government's reforms focus on three key institutional changes. First, a new Financial Policy Committee (FPC) will be established in the Bank of England, with responsibility for 'macro-prudential' regulation, or regulation of stability and resilience of the financial system as a whole. Second, 'micro-prudential' (firm-specific) regulation of financial institutions that manage significant risks on their balance sheets will be carried out by an operationally independent subsidiary of the Bank of England, the Prudential Regulation Authority (PRA). Thirdly, responsibility for conduct of business regulation will be transferred to a new specialist regulator, the Financial Conduct Authority (FCA). Individual chapters cover: Bank of England and Financial Policy Committee; Prudential Regulation Authority; Financial Conduct Authority; regulatory process and co-ordination; compensation, dispute resolution and financial education; European and international issues; next steps; how to respond; impact assessment. The chapters contain significant detail on how the legislative framework will be constructed in order to deliver the Governments' priorities for the framework. The Government will consult on these proposals with a view to publishing a draft bill in spring 2011.

Book excerpt: This Treasury Committee report into the Financial Conduct Authority (FCA) contains a number of recommendations for the Government's consideration ahead of the drafting and publication of the Financial Services Bill early in 2012. Among the recommendations are: (a) that the Government should legislate to give the FCA a primary objective to promote effective competition for the benefit of the consumer (in line with the thinking of the Independent Commission on Banking and the Office of Fair Trading); (b) the Government must put competition at the heart of the new regulatory framework; (c) that the FCA develops far more reliable estimates, in collaboration with the industry, of its own cost effectiveness; (d) that the Government differentiates between retail and wholesale consumers; (e) that both the FCA and the financial services industry make better efforts to communicate with each other; (f) that the current legislative proposals be revised to ensure that the FCA is properly accountable to Parliament and that tools are available to enable the required level of explanation from the regulator.
