Where previous books have focused on ideological grounds, The Politics of Intimacy explores dying as the site where policies are negotiated and implemented. Intimacy comprises the emotional experience of the end of life and how we acknowledge it—or not—through institutions. This process shows that end-of-life controversy relies on the conflict between the individual and these institutions, a relationship that is the cornerstone of Western liberal democracies. Through interviews with mourners, stakeholders, and medical professionals, examination of media debates in France and the Czech Republic, Durnová shows that liberal institutions, in their attempts to accommodate the emotional experience at the end of life, ultimately fail. She describes this deadlock as the “politics of intimacy,” revealing that political institutions deploy power through collective acknowledgment of individual emotions but fail to maintain this recognition because of this same experience.

Book excerpt: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life... The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

Assisted suicide is a contentious topic and one which has been the subject of judicial and academic debate internationally. The central objective of the book is to approach the question of the ban’s compatibility with the European Convention on Human Rights afresh; freed from the constraints of the existing case law and its erroneous approach to the legal issues and selective reliance on empirical data. The book also examines the compatibility of the ban on assisted suicide with rights which have either been erroneously disregarded or not considered by either the domestic courts or the European Court of Human Rights. Having regard to human rights jurisprudence more broadly, including in the context of abortion, the research and analysis undertaken here demonstrates that the ban on assisted suicide violates the rights of a significant number of individuals to life, to freedom from torture or inhuman or degrading treatment and to private life. Such analysis does not depend on a strained or contrived approach to the rights at issue. Rather, the conclusions flow naturally from a coherent, logical application of the established principles governing those rights. While the focus of the book is the Suicide Act 1961, the conclusions reached have implications beyond England and Wales, including for the other devolved jurisdictions and international jurisdictions. The ambiguities of the female body are therein exposed. This work examines the relationship between the female body and biomedicine. Many possibilities are offered to women through biomedical techniques: from assistance to procreate (with assisted reproduction) to refusal to do so (contraception, voluntary sterilization, termination of pregnancy); to be informed of genetic predispositions (through the use of available genetic tests); or to improve their physical appearance with cosmetic surgery. But a recurrent question arises: with its rapid progress and its extreme medicalization of the body, can biomedicine liberate women? Or rather, given the risks of the commodification of the body or its parts, is it not a source of exploitation ? The authors of this work, jurists, anthropologists, philosophers, sociologists and doctors, have explored these questions. The contributions from nineteen countries in this international multidisciplinary study analyse the reality of the amazing developments of biomedicine on the female body. Numerous systems are compared for the first time; European, African, North and South American, but also Chinese and Japanese. Beyond highlighting differences, and identifying similarities in the development of “enhancement medicine”, the objective of this work is ultimately to show the complexity surrounding the question of a woman’s freedom over her body and the extent to which this is limited by the State.

Physician-Assisted Suicide and Euthanasia: Before, During, and After the Holocaust explores the history of euthanasia before and during the Third Reich in depth and demonstrate how Nazi physicians incorporated mainstream Western philosophy, eugenics, population medicine, prevention, and other medical ideas into their ideology. This book reveals that euthanasia was neither forced upon physicians nor wantonly practiced by a few fanatics, but widely embraced by Western medicine before being sanctioned by the Nazis. Contributors then reflect on the significance of this history for contemporary debates about PAS and euthanasia. While they take different views regarding these practices, almost all agree that there are continuities between the beliefs that the Nazis used to justify euthanasia and the ideology that undergirds present-day PAS and euthanasia. Fighting Machines explores the relationship between lethal autonomous weapons (LAWS), the concept of human dignity, and international law. Much of this analysis speaks to three fundamental and related problems: When a LAWS takes a human life, is that killing a violation of human dignity? Can states and non-state actors use LAWS in accordance with international law? And are there certain responsibilities of human decision-making during wartime that we should not delegate to machines? In the book, Dan Saxon argues that the use of LAWS to take human life constitutes a violation of human dignity. Rather than concentrating on the victims of the use of lethal force, Saxon instead focuses on the technology and relevant legal principles and rules to advance several propositions. First, as LAWS operate at increasingly greater speeds, their use will undermine the opportunities for, and the value of, human reasoning and judgment. Second, by transferring responsibility for reasoning and judgment about the use of lethal force to computer software, the use of LAWS violates the dignity of the soldiers, commanders, and law enforcement officers who historically have made such decisions, and, therefore, breaches international law. Third, weapon designs that facilitate teamwork between humans and autonomous systems are necessary to ensure that humans and LAWS can operate interdependently so that individuals can fulfil their obligations under international law—including the preservation of their own dignity—and ensure that human reasoning and judgment are available for cognitive functions better suited to humans than machines. Fighting Machines speaks to the fields of international humanitarian law, human rights, criminal law, and legal philosophy.
