Book excerpt: La recherche porte sur le parcours de dix travailleuses québécoises ayant déposé une réclamation pour faire reconnaître une lésion professionnelle à la Commission des normes, de l'équité, de la santé et de la sécurité du travail (CNESST), et ce, à la suite d'une situation de harcèlement sexiste ou sexuel au travail. En droit québécois, si une travailleuse touchée par du harcèlement sexiste ou sexuel qui développe une maladie en raison de ce harcèlement veut obtenir une compensation monétaire, son seul recours est une réclamation en vertu de la Loi sur les accidents du travail et les maladies professionnelles (LATMP). Aux termes de cette Loi, le régime d'indemnisation est "sans égard à la faute", signifiant que l'employeur et le harceleur ne peuvent pas être poursuivis ni tenus responsables du harcèlement. Au vu du contexte dans lequel s'inscrit la qualification du harcèlement sexiste et sexuel à titre d'accident du travail, le mémoire a pour but de faire dialoguer une perspective critique et féministe avec les expériences des travailleuses. Quelle représentation font les travailleuses de leur trajectoire et comment vivent-elles le processus de réclamation? De quelle façon le cadre juridique façonne-t-il leur parcours à la suite d'une situation de harcèlement sexiste ou sexuel au travail? En quoi le processus de réclamation produit-il une occultation des violences patriarcales? Les résultats de l'enquête indiquent que la banalisation du harcèlement et l'absence de soutien de l'employeur portent les travailleuses à consulter un·e médecin, faute d'une réponse adéquate plus tôt. Ensuite, elles s'engagent dans un parcours médico-administratif épuisant, susceptible de se judiciariser, entraînant une médicalisation du harcèlement et une victimisation secondaire des travailleuses. Leur santé mentale est au coeur du litige, puisque l'employeur peut utiliser l'entièreté de leur dossier médical pour contester leur réclamation. Les résultats de l'enquête montrent qu'à plusieurs égards, la LATMP n'offre pas un recours adapté aux victimes de violences sexistes et sexuelles et entraîne la dépolitisation de celles-ci. -- Page viii.
