Using fascinating examples drawn from current business and organisational practice in Asia, it focuses on the impact that Japanese modernity has made in Asia as a model to be imitated because of its apparent success in adopting western technologies while retaining its own cultural identity. At the same time, Japan itself is a dominant force in modernity in East and South East Asia, exporting its own type of modernisation, management and business practices, and models of 'traditional' social relations which do not necessarily correspond to the traditions of other Asian cultures.This adds another element to the conventional model of modernity as a dialogue between West and East; without considering Japan's special significance in the region, any critical assessment of the modernising process in Asia would not be possible. Although the Japanese state aggrandizers’ reliance on this discourse did not create the imperial nation Japan would become, their fluent use of its terms inscribed Japan’s claims as legal practice within Japan and abroad. Focusing on Japan’s annexation of Korea in 1910, Alexis Dudden gives long-needed attention to the intellectual history of the empire and brings to light presumptions of the twentieth century’s so-called international system by describing its most powerful—and most often overlooked—member’s engagement with that system. Early chapters describe the global atmosphere that declared Japan the legal ruler of Korea and frame the significance of the discourse of early twentieth-century international law and how its terms became Japanese. Dudden then brings together these discussions in her analysis of how Meiji leaders embedded this discourse into legal precedent for Japan, particularly in its relations with Korea. Remaining chapters explore the limits of these ‘universal’ ideas and consider how the international arena measured Japan’s use of its terms. Dudden squares her examination of the legality of Japan’s imperialist designs by discussing the place of colonial policy studies in Japan at the time, demonstrating how this new discipline further created a common sense that Japan’s empire accorded to knowledgeable practice. This landmark study greatly enhances our understanding of the intellectual underpinnings of Japan’s imperial aspirations. In rising to become the first Asian and non-Christian world power, Meiji Japan (1868-1912) challenged this deeply-held conviction, and in so doing threatened racial and cultural hierarchies central to American ideology and foreign policy. To reconcile Japan's stature with American notions of Western supremacy, both nations embarked on an active campaign to construct an identity for the Japanese which would recognize Japan's progress and abilities without threatening Americans' faith in white, Christian superiority. Japanese efforts included reassurances in diplomatic exchanges and in the American press that their nation adhered to the central tenets of Western civilization, namely constitutional government, freedom of religion, and open commerce. Many anxious Americans eagerly accepted such offerings, and happily re-conceived the Japanese as adoptive Anglo-Saxons. As with the best new work in diplomatic history, in Outposts of Civilization Henning considers culture to be integral to understanding foreign relations. Thus in addition to official documents and press reports, he examines American missionaries' writings on the Japanese, and American and Japanese art and literature produced during the Gilded Age. In exploring the delicate and deliberate process of identity construction, and how these discourses on race and progress resonated throughout the twentieth century, Henning has produced a fascinating and important study of American-Japanese relations.

Book excerpt: Domestic and international development strategies often focus on private ownership as a crucial anchor for long-term investment; the security of property rights provides a foundation for capitalist expansion. In recent years, Thailand's policies have been hailed as a prime example of how granting formal land rights to poor farmers in low-income countries can result in economic benefits. But the country provides a puzzle: Thailand faced major security threats from colonial powers in the nineteenth century and from communism in the twentieth century, yet only in the latter case did the government respond with pro-development tactics. In Land and Loyalty, Tomas Larsson argues that institutional underdevelopment may prove, under certain circumstances, a strategic advantage rather than a weakness and that external threats play an important role in shaping the development of property regimes. Security concerns, he find, often guide economic policy. The domestic legacies, legal and socioeconomic, resulting from state responses to the outside world shape and limit the strategies available to politicians. While Larsson’s extensive archival research findings are drawn from Thai sources, he situates the experiences of Thailand in comparative perspective by contrasting them with the trajectory of property rights in Japan, Burma, and the Philippines.

Arguing against the popular stereotype of Japan as a non-litigious society, an international group of contributors from Japan, Taiwan, Germany, and the U.S., explores how in Japan and its colonies, as elsewhere in the modern world, law became a fundamental means of creating and regulating gendered subjects and social norms in the period from the 1870s to the 1950s. Rather than viewing legal discourse and the courts merely as technologies of state control, the authors suggest that they were subject to negotiation, interpretation, and contestation at every level of their formulation and deployment.
