Book Synopsis Managing the Undesirables by : Michel Agier
Download or read book Managing the Undesirables written by Michel Agier and published by Polity. This book was released on 2011-01-25 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: Official figures classify some fifty million of the world’s people as 'victims of forced displacement'. Refugees, asylum seekers, disaster victims, the internally displaced and the temporarily tolerated - categories of the excluded proliferate, but many more are left out of count. In the face of this tragedy, humanitarian action increasingly seems the only possible response. On the ground, however, the 'facilities' put in place are more reminiscent of the logic of totalitarianism. In a situation of permanent catastrophe and endless emergency, 'undesirables' are kept apart and out of sight, while the care dispensed is designed to control, filter and confine. How should we interpret the disturbing symbiosis between the hand that cares and the hand that strikes? After seven years of study in the refugee camps, Michel Agier reveals their 'disquieting ambiguity' and stresses the imperative need to take into account forms of improvisation and challenge that are currently transforming the camps, sometimes making them into towns and heralding the emergence of political subjects. A radical critique of the foundations, contexts, and political effects of humanitarian action.
Book Synopsis Territorial Shock by : Gertjan Dijkink
Download or read book Territorial Shock written by Gertjan Dijkink and published by LIT Verlag Münster. This book was released on 2019 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: We are in the embrace of territorial shock today. Globalization with its migrants, foot-loose firms, cyber-war and surging income inequality induces political instability and longing for a `saviour'. This book puts such events in a historical perspective. New social trends collide with territorial principles (closure, identity, governance) that always have been taken for granted. Should we invest the new monarchs with the same authority as the pope (16th century) or accept other classes as co-citizens (19th century)? The answers implied a moral shift and so do our problems with globalization.

Book Synopsis Multinationales Comme Agents Du Changement by : Lorraine Eden
Download or read book Multinationales Comme Agents Du Changement written by Lorraine Eden and published by . This book was released on 1994 with total page 140 pages. Available in PDF, EPUB and Kindle. Book excerpt: How are the biggest firms in Canada responding to these changes, and what responses should they evoke from the makers of foreign direct investment policy? This paper seeks to answer these questions. A brief historical summary traces Canada's treatment of foreign direct investment from 1960 to the present and the development of a "hub-and-spoke" economic relationship between Canada and the United States. The survey points to the deep integration of the Canadian and U.S. economies and suggests that this integration will become even more extensive and multifaceted as a result of regional trading agreements.
Book Synopsis Jurisdiction in International Law by : Cedric Ryngaert
Download or read book Jurisdiction in International Law written by Cedric Ryngaert and published by . This book was released on 2015 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: This fully updated second edition of Jurisdiction in International Law examines the international law of jurisdiction, focusing on the areas of law where jurisdiction is most contentious: criminal, antitrust, securities, discovery, and international humanitarian and human rights law. Since F.A. Mann's work in the 1980s, no analytical overview has been attempted of this crucial topic in international law: prescribing the admissible geographical reach of a State's laws. This new edition includes new material on personal jurisdiction in the U.S., extraterritorial applications of human rights treaties, discussions on cyberspace, the Morrison case. Jurisdiction in International Law has been updated covering developments in sanction and tax laws, and includes further exploration on transnational tort litigation and universal civil jurisdiction. The need for such an overview has grown more pressing in recent years as the traditional framework of the law of jurisdiction, grounded in the principles of sovereignty and territoriality, has been undermined by piecemeal developments. Antitrust jurisdiction is heading in new directions, influenced by law and economics approaches; new EC rules are reshaping jurisdiction in securities law; the U.S. is arguably overreaching in the field of corporate governance law; and the universality principle has gained ground in European criminal law and U.S. tort law. Such developments have given rise to conflicts over competency that struggle to be resolved within traditional jurisdiction theory. This study proposes an innovative approach that departs from the classical solutions and advocates a general principle of international subsidiary jurisdiction. Under the new proposed rule, States would be entitled, and at times even obliged, to exercise subsidiary jurisdiction over internationally relevant situations in the interest of the international community if the State having primary jurisdiction fails to assume its responsibility.

Book Synopsis Choice of Law in Copyright and Related Rights by : Mireille M. M. van Eechoud
Download or read book Choice of Law in Copyright and Related Rights written by Mireille M. M. van Eechoud and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nobody denies that the traditional territorial approach to copyright and other intellectual property rights has come under pressure. Yet it persists. Faced with the need to determine the applicable law in cross-border cases, lawyers everywhere wrestle with the implications of the territorial nature of copyright and related rights. In this book Mireille van Eechoud clears the way to the formulation of conflict rules that reflect the purpose of copyright law- to protect creators and stimulate the production and use of information- without reverting to old-fashioned notions of territoriality. She shows how the applicable law can be determined for four distinct legal avenues of intellectual property law: Which exclusive rights exist in an intellectual creation and for how long; Who is considered to own such right; How can these rights be transferred; and What continues infringement of copyright and related rights. Mireille van Eechoud shows how, when each of these questions is approached in the light of the different allocation principles used in modern choice of law, a new clarity begins to emerge that promises in time to build a set of conflict rules well suited to the unprecedented copyright and related rights issues that we find so difficult to resolve today. Her in-depth analysis draws in the classis multilateral conventions and treaties, underlying policies, technological and economic developments, utilitarian grounds versus justice considerations, and issues of infringement in the digital environment. Book Synopsis Rapports Université-industrie en Sciences Et Technologie by : Jérôme Doutriaux
Download or read book Rapports Université-industrie en Sciences Et Technologie written by Jérôme Doutriaux and published by . This book was released on 1995 with total page 178 pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper updates and improves our understanding of university-industry relations in Canada. It begins with the volume of literature produced on this topic in the late 1980s and strengthens some of the initial, and perhaps, intuitive conclusions of this literature with findings from recent studies and some surveys. Benefiting from recent scholarship, the paper places significant emphasis on regional approaches to technology transfer. It insists that a variety of organizations, not just universities and industry, have important roles to play in technology transfer and local economic development, and suggests that both different sources of funding and approaches are important and should be complementary.
