Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Narrating the complex interactions between architects, planners, policy makers, inhabitants, and social scientists, he shows how postwar dwelling was caught between the purview of the welfare state and the rise of mass consumerism. The Social Project unearths three decades of architectural and social experiments centered on the dwelling environment as it became an object of modernization, an everyday site of citizen participation, and a domain of social scientific expertise. Beyond state intervention, it was this new regime of knowledge production that made postwar modernism mainstream. Censorship was abolished, and France appeared to be on a path towards tolerance, pluralism, and civil liberties. A mere four years later, the country descended into a period of political terror, as thousands were arrested, tried, and executed for crimes of expression and opinion. In Policing Public Opinion in the French Revolution, Charles Walton traces the origins of this reversal back to the Old Regime. He shows that while early advocates of press freedom sought to abolish pre-publication censorship, the majority still firmly believed injurious speech--or calumny--constituted a crime, even treason if it undermined the honor of sovereign authority or sacred collective values, such as religion and civic spirit. With the collapse of institutions responsible for regulating honor and morality in 1789, calumny proliferated, as did obsessions with it. Drawing on wide-ranging sources, from National Assembly debates to local police archives, Walton shows how struggles to set legal and moral limits on free speech led to the radicalization of politics, and eventually to the brutal liquidation of "calumniators" and fanatical efforts to rebuild society's moral foundation during the Terror of 1793-1794. With its emphasis on how revolutionaries drew upon cultural and political legacies of the Old Regime, this study sheds new light on the origins of the Terror and the French Revolution, as well as the history of free expression.

Book excerpt: Benjamin Constant (1767-1830) was born in Switzerland and became one of France's leading writers, as well as a journalist, philosopher, and politician. His colourful life included a formative stay at the University of Edinburgh; service at the court of Brunswick, Germany; election to the French Tribunate; and initial opposition and subsequent support for Napoleon, even the drafting of a constitution for the Hundred Days. Constant wrote many books, essays, and pamphlets. His deepest conviction was that reform is hugely superior to revolution, both morally and politically. While Constant's fluid, dynamic style and lofty eloquence do not always make for easy reading, his text forms a coherent whole, and in his translation Dennis O'Keeffe has focused on retaining the 'general elegance and subtle rhetoric' of the original. Sir Isaiah Berlin called Constant 'the most eloquent of all defenders of freedom and privacy' and believed to him we owe the notion of 'negative liberty', that is, what Biancamaria Fontana describes as "the protection of individual experience and choices from external interferences and constraints." To Constant it was relatively unimportant whether liberty was ultimately grounded in religion or metaphysics -- what mattered were the practical guarantees of practical freedom -- "autonomy in all those aspects of life that could cause no harm to others or to society as a whole." This translation is based on Etienne Hofmann's critical edition of Principes de politique (1980), complete with Constant's additions to the original work.
